The Fair Sentencing Act of 2010 reduced the sentencing disparity between crack and powder cocaine from 100:1 to 18:1. It also eliminated mandatory minimum sentences for simple possession of crack cocaine. The Act was passed to correct unfair sentencing ratios that treated crack cocaine offenses much more harshly than powder cocaine offenses. The Sentencing Commission implemented amendments to reflect the directives of the new Act.

signed into law, reducing to approximately 18 to 1 the
sentencing ratio amount of powder cocaine versus crack cocaine
that triggers the same penalty. The legislation also eliminates
the mandatory minimum for simple possession of crack. The
Sentencing Commission has promulgated amendments
implementing the directives of the Act.
