- 13. LISTA DE ESCASOS ABASTOS ( LEA) Anexo 3-A Notas Generales Interpretativas Regla 4 y Nota 32(m)(viii)(D) Del Sistema Armonizado De Los EE.UU. Los insumos de la LEA se pueden emplear para elaborar el tejido exterior o pueden ser telas que forman parte del tejido exterior. Cuando este sea el caso: El vestido del Capítulo 61 ó 62 será considerada originaria sin tener en cuenta el origen de cualquiera de los forros visibles descritos en la Regla de Cap í tulo 1, los tejidos angostos descritos en la Regla de Capítulo 3, los hilos de coser descritos en la Regla de Capítulo 4, o los tejidos de bolsillo descritos en la Regla de Capítulo 5, si cualquiera de tales materiales es identificado en el Anexo 3-B y la mercancía cumple con todos los otros requerimientos aplicables para el trato arancelario preferencial bajo el Acuerdo de las Partes.

Una mercancía textil o del vestido que no es una mercancía originaria porque ciertos hilados utilizados en la producción del componente de la mercancía que determina la clasificación arancelaria de la mercancía no sufre el cambio de clasificación arancelaria aplicable establecido en el Anexo 3-A, no obstante será considerada una mercancía originaria si los hilados son aquellos descritos en la Sección 204(b) (3)(B)(vi)(VI) de la Andean Trade Preference Act (19 U.S.C. 3203(b)(3)(B)(vi)(IV)). Hilado de nailon de terceros países de los Acuerdos vigentes desde el día primero de Enero del 1995 (January 1, 1995). NAFTA y Israel. Nota: Las subpartidas (Cap í tulo 54) de los hilados de filamento de nailon de los Acuerdos mencionados se encuentra en la Nota 32(d)(i)(B) Del Sistema Armonizado de los EE.UU.

EJEMPLO: CHAQUETA DE HOMBRE 6201.92 : Chaqueta (jacket) 100% algodón La regla de origen requiere que empezando desde el hilado 5204 al tejido 5212 y todas las operaciones siguientes hasta que el vestido este terminado o acabado se lleven acabo en el territorio de las Partes. Además, (a) el corte y costura debe de llevarse acabo en las Partes; y (b) si el vestido contiene forro visible es requerido que el forro visible sea formado en el territorio de las Partes. - CHAPTER THREE TEXTILES AND WEARING APPAREL RULES OF ORIGIN SPECIFIC REQUIREMENTS
- The rules of origin reflect the limit or the capacity of the foreign materials that may be sourced from outside the Parties. The rules of origin are based on the classification of the finished good. The rule of origin tariff shift requirement only apply to the foreign components used in the production of the finished good. Based on the type of the textile article, there are several exceptions that affect the Rules of Origin
- EXAMPLE: wearing apparel rule of origin Normally the rule of origin contains two parts: Tariff shifts Cut and Sewn, knit to shape or assembly within the territory of the Parties.
- Example: Rule of Origen The rule of origin may contain a third part; the visible lining rule. Note: The visible lining rule does not apply to removable linings.
- Understanding the Rules The foreign components must be classified prior to being integrated in the production of the finished good to verify the following: If the foreign component meets the tariff shift requirement of the rule of origin of the finished good; and If the foreign component is not subject to the exceptions of the rules of origin (Chapter Rules, elastomeric yarns, De minimis, etc.)
- Understanding the Rules Chapters 61,62 and 63, the Rule of Origin and the exceptions to the Rule of Origin only apply to the component that determines the classification of the finished good. This means that, the findings, trimmings, decorations, ornaments and interlining may be sourced from outside the Parties. Caution that the collars, cuffs of knit shape components must be formed within the territory of the Parties.

- Chapter three Textiles and Wearing Apparel - Exceptions of the Rules of Origin Chapter Rules - Rules 1 through 5 Short Supply List De Minimis Elastomeric Yarns Sets Nylon Filament Yarns Note: Exceptions of the Rules of Origin and the component that determines the classification of the finished good.
- Chapter Rules 61,62 and 63 HTSUS GN32(n): The following components must be formed within the territory of the Parties. Visible lining (formed from yarn) Narrow Fabrics of subheadings 5806.20 and 60.02 (formed from yarn) Pocket bag fabric (formed and finished) Sewing thread (formed and finished) Note: sewing thread of heading 5508 may be sourced from outside the territory of the Parties.
- HTSUS GN32(n): Chapter rule 61 and 62 Rule 2, Chapter 63, Rule 1. The rule applicable to that good shall only apply to the component that determines the tariff classification of the good and such component must satisfy the tariff change requirements set out in the rule for that good.
- HTSUS GN32(n): A good of this chapter, other than a good of subheading 6212.10, containing fabrics of heading 6002 or subheading 5806.20 shall be considered originating only if such fabrics are both formed from yarn and finished in the territory of Peru, the United States, or both. Note: Since the chapter rule only applies to subheading 6212.10. This means that other goods of chapter 62 containing narrow fabrics of subheading 5806.20 and heading 60.02 may be sourced from outside the Parties.
- HTSUS GN32(m)(viii)(D) Short Supply List: An apparel good of Chapters 61 or 62 shall be considered originating regardless of the origin of any visible lining fabric described in chapter rule 1 to such chapters, narrow fabrics described in chapter rule 3 to such chapters, sewing thread described in chapter rule 4 to such chapters or pocketing fabric described in chapter rule 5 to such chapters, the foregoing as set forth in subdivision (n) of this note, if any such material is identified in U.S. note 29 to subchapter XXII of chapter 98 and the good meets all other applicable requirements for preferential tariff treatment under this note.
- HTSUS GN32(d)(i): textile or apparel good that is not an originating good under the terms of this note because certain fibers or yarns used in the production of the component of the good that determines the tariff classification of the good do not undergo an applicable change in tariff classification, shall be considered, an originating good if the total weigh of all such fibers or yarns in that component is not more than ten percent of the total weight of that component.
- HTSUS GN32(d)(i): A textile or apparel good containing elastomeric yarns in the component of the good that determines the tariff classification of the good shall be considered originating good only if such yarns are wholly formed in the territory of Peru or the Unites States or both.
- HTSUS GN32(d)(ii)(A)(B): Elastomeric yarns does not include latex; and a yarn is “Wholly Formed” in the territory of Peru or the United States if all the production processes and finishing operations starting with the extrusion of filaments, strips, films or sheets, or the spinning of all fibers into yarn, or both, and ending with a finished yarn or plied yarn, took place in the territory of Peru or the United States, as the case may be.
- HTSUS GN32(m)(viii)(B)(3): The originating fabrics referred to in subdivision (B)(3) may contain up to 10 percent by weight of fibers or yarns that do not undergo a applicable change in tariff classification set out in subdivision (n) of this note. Any elastomeric yarn contained in an originating fabric or knit to shape component referred to in subdivision (B)(3) must be formed in the territory of Peru, the United States or both. Elastomeric yarns do not qualify for the De Minimis. In addition, knit to shape components includes collars and cuffs.
- HTSUS GN32(c)(v): Goods classified as goods put up in sets for retail sale as provided for in general rule of interpretation 3 to the tariff schedule shall not be considered to be originating goods unless…(A) each of the goods in the set is an originating good; or (B) the total value of the non-originating goods in the set does not exceed..(1) in the case of a textile or apparel good, 10% of the adjusted value of the set. Note: This is the only part in the textile goods that contains regional value content requirement.
- HTSUS GN32(d)(i)(B): Nylon Filament yarns (other than elastomeric yarn) provided for in subheadings……of the tariff schedule from a country that is a party of an agreement with the United States establishing a free trade area which entered into force before January 1, 1995.
- Example: men’s jacket 100% cotton
- The rule of origin requires that beginning from the yarn through the production of the fabric of headings 5204 though 5212 must occurred within the parties. In addition, cut and sewn. If the good contains visible lining it must comply with the Chapter rule requirements. The visible lining rule does not apply to removable linings.
- COMPONENTS: FABRIC OF THE EXTERIOR SHELL: YARN AND FABRIC MADE IN PERU VISIBLE LINING FABRIC: 100% POLYESTER FORMED IN PERU POCKET FABRIC: 100% POLYESTER FORMED IN PERU SEWING THREAD: HEADING 52.04 FORMED IN U.S. CUT AND SEWN: PERU NOTE: AMONG OTHER REQUIRE DOCUMENTS DURING THE ORIGIN VERIFICATION IT WILL BE REQUIRE TO PROVIDE AFFIDAVITS FOR EACH OF THE COMPONENTS MENTIONED ABOVE TO VERIFY THAT THE COMPONENTS WERE PRODUCED WITHIN THE TERRITORY OF THE PARTIES.
- EXAMPLE: WOMEN’S BLOUSE 97% COTTON 3% SPANDEX
- COMPONENTS: FABRIC YARNS: COTTON YARNS MADE IN PERU AND SPANDEX YARN MADE IN U.S. FABRIC: MADE IN PERU SEWING THREAD: HEADING 52.04 FORMED IN U.S. CUT AND SEWN: PERU NOTE: AMONG OTHER REQUIRED DOCUMENTS DURING THE ORIGIN VERIFICATION IT WILL BE REQUIRE TO PROVIDE AFFIDAVITS OF THE YARNS AND FABRIC, CUT AND SEWN, SEWING THREAD. THE AFFIDAVITS FOR THE SPANDEX TO VERIFY IT WAS WHOLLY PROCUDED WITHIN THE TERRITORY OF THE PARTIES.
- EXAMPLE: WOMEN’S VEST MADE FROM KNIT AND WOVEN FABRICS KNIT FABRIC: BACK PANEL, CONTAINS 55%RAMIE AND 54% COTTON WOVEN FABRIC: FRONT PANEL, CONTAINS 100% COTTON
