1952 
WAGES – Clause (b) of Section 2 
"Basic wages” means all emoluments which are earned by an employee while on duty or on leave or on holidays 
with wages in either case in accordance with the terms of the contract of employment and which are paid or 
payable in cash to him. 
But does not include 
i.The cash value of any food concession; 
ii.Any dearness allowance (that is to say, all cash payments by whatever name called paid to an employee on 
account of a rise in the cost of living), House rent allowance, Overtime allowance, Bonus, Commission or any 
other similar allowance payable to the employee in respect of his employment or of work done in such 
employment. 
iii.Any presents made by the employer; 
EMPLOYEE – Clause (f) of Section 2 
Any person who is employed for wages in any kind of work, manual or otherwise, in or in connection with the 
work of an establishment and who gets his wages directly or indirectly from the employer, and includes any 
person,- 
(i)employed by or through a contractor in or in connection with the work of the establishment; 
(ii)engaged as an apprentice, not being an apprentice engaged under the Apprentices Act, 1961 (52 of 1961) or 
under the standing orders of the establishment
EMPLOYEES’ STATE INSURANCE ACT, 
1948 
WAGES – Clause (22) of Section 2 
All remuneration paid or payable in cash to an employee, if the terms of the contract of employment, express or 
implied, were fulfilled and includes any payment to an employee in respect of any period of authorized leave, 
lock-out, strike which is not illegal or layoff and] other additional remuneration, if any, (paid at intervals not 
exceeding two months). 
But does not include — 
(a) any contribution paid by the employer to any pension fund or provident fund, or under this Act ; 
(b) any travelling allowance or the value of any travelling concession ; 
(c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his 
employment ; or 
(d) any gratuity payable on discharge 
EMPLOYEE – Clause (9) of Section 2 
Any person employed for wages in or in connection with the work of a factory or establishment to which this Act 
applies and-i. 
who is directly employed by the principal employer on any work of the factory or establishment whether such 
work is done by the employee in the factory or establishment or elsewhere 
ii.who is employed by or through an immediate employer on the premises of the factory or establishment or 
under the supervision of the principal employer or his agent on work which is ordinarily part of the work of the 
factory or establishment or which is preliminary to the work carried on in or incidental to the purpose of the 
factory or establishment 
iii.whose services are temporarily lent or let on hire to the principal employer by the person with whom the 
person whose services are so lent or let on hire has entered into a contract of service
THE FACTORIES ACT, 1948 
WORKERS – Clause (L) of Section 2 
Worker means a person employed 
a)directly or through any agency (including a contractor) with or without the knowledge 
of the principal employer whether for remuneration or not 
b)in any manufacturing process, or in cleaning any part of the machinery or premises 
used for a manufacturing process, 
c)in any other kind of work incidental to, or connected with the manufacturing process, 
or the subject of the manufacturing process 
But does not include 
-- Any member of the armed forces of the Union;
INDUSTRIAL DISPUTES ACT, 1947 
WAGES – CLAUSE (rr) OF SECTION 2 
All remuneration capable of being expressed in terms of money, which would, if the terms of employment, expressed or 
implied, were fulfilled, be payable to a workman in respect of his employment or of work done in such employment, 
and includes-- 
(i) such allowances (including dearness allowance) as the workman is for the time being entitled to; 
(ii) the value of any house accommodation, or amenities 
(iii) any travelling concession; 
(iv) any commission payable on the promotion of sales or business or both. 
But does not include -- 
(a) any bonus; 
(b) any contribution paid or payable by the employer to any pension fund or provident fund or for the benefit of the 
workman under any law for the time being in force; 
(c) any gratuity payable on the termination of his service 
WORKMAN – Clause (s) of Section 2 
Any person (including an apprentice) employed in any industry to do any manual, unskilled, skilled, technical, 
operational, clerical or supervisory work for hire or reward, whether the terms of employment be express or implied. 
But does not include any such person-- 
i.who is subject to the Air Force Act, 1950 (45 of 1950), or the Army Act, 1950 (46 of 1950), or the Navy Act, 1957 (62 of 
1957) 
ii.who is employed in the police service or as an officer or other employee of a prison 
iii.who is employed mainly in a managerial or administrative capacity 
iv.who, being employed in a supervisory capacity, draws wages exceeding one thousand six hundred rupees per 
exercises.
Minimum Wages Act,1948 
WAGES – Clause (h) of Section 2 
All remuneration capable of being expressed in terms of money which would if the terms of the contract of 
employment express or implied were fulfilled be payable to a person employed in respect of his employment or 
of work done in such employment and includes house rent allowance 
But does not include - 
(i)The value of supply of light, water, medical or other amenities 
(ii)Any contribution paid by the employer to any person fund or provident fund or under any scheme of social 
insurance 
(iii)Any traveling allowance or the value of any traveling concession 
(iv)Any sum paid to the person employed to defray special expenses entailed on him by the nature of his 
employment; 
(v)Any gratuity payable on discharge 
EMPLOYEE – Clause (i) of Section 2 
Any person who is employed for hire or reward to do any work, skilled or unskilled, manual or clerical, in a 
scheduled employment in respect of which minimum rates of wages have been fixed; and includes 
a)An out-worker to whom any articles or materials are given out by another person to be made up, cleaned, 
washed, altered, ornamented, finished, repaired, adapted or otherwise processed for sale for the purposes of 
the trade or business 
b)An employee declared to be an employee by the appropriate Government 
But does not include 
- - Any member of the Armed Forces
Gratuity Act,1972 
WAGES – Clause (s) of Section 2 
All emoluments which are earned by an employee while on duty or on leave in accordance with the terms and 
conditions of his employment and which are paid or are payable to him in cash and includes dearness allowance 
But does not include 
-- Any bonus, commission, house rent allowance, overtime wages and any other allowance. 
EMPLOYEE – Clause (e) of Section 2 
Any person (other than an apprentice under Apprentices Act, 1961) employed 
1.on wages in any establishment, factory, mine, oilfield, plantation, port, railway company or shop, to do any 
skilled, semi- skilled, or unskilled, manual, supervisory, technical or clerical work, whether the terms of such 
employment are express or implied 
2.whether or not such person is employed in a managerial or administrative capacity, 
But does not include 
-- Any such person who holds a post under the Central Government or a State Government and is governed by 
any other Act or by any rules providing for payment of gratuity.
Payment of Wages Act, 1936 
WAGES – Clause (vi) of Section 2 
All remuneration (whether by way of salary, allowance or otherwise) expressed in terms of money or capable of 
being so expressed which would, if the terms of employment, express or implied, were fulfilled, be payable to a 
person employed in respect of his employment or work done n such employment, and includes:- 
1. any remuneration payable under any award or settlement between the parties or orders of a court 
2. any remuneration in respect of overtime work or holidays or any leave period 
3. any additional remuneration (whether called a bonus or by any other name) 
4. any sum to which the person is entitled under any scheme framed under any law for the time being in force 
But does not include- 
1. any bonus, profit-sharing or otherwise which does not form part of the remuneration payable 
2. value of any house accommodation or other amenity or any service excluded from the computation of wages 
3. any contribution paid by the employer to any pension or provident fund 
4. any traveling allowance 
5. any sum paid to defray special expenses entitled on him by the nature of his employment 
6.any gratuity payable
Contract Labour Act, 1970 
WAGES – Clause (h) of Section 2 
Definition of Wages is same as Clause (vi) of Section 2 of Payment of Wages Act, 1936 
WORKMAN – Clause (i) of Section 2 
Any person employed in or in connection with the work of any establishment to do any skilled, semiskilled or un-skilled 
manual, supervisory, or clerical work for hire or reward, whether the terms of employment be express or 
implied, 
But does not include any such person-- 
(A)who is employed mainly in a managerial or administrative capacity; or 
(B)who, being employed in a supervisory capacity draws wages exceeding five hundred rupees per exercises, either by 
the nature of the duties attached to the office or by reason of the powers vested in him, functions mainly of a 
managerial nature; or 
(C)who is an out-worker, that is to say, a person to whom any articles or materials are given out by or on behalf of the 
Principal employer to be made up, cleaned, washed, altered, ornamented, finished, repaired, adapted or otherwise 
processed for sale for the purposes of the trade or business of the principal employer and the process is to be carried 
out in the home of the out-worker or in some other premises, not being premises under the control & management of 
the principal employer.
Workmen' S Compensation Act, 1923 
WAGES – Clause (m) of Section 2 
Any privilege or benefit which is capable being estimated in money other than a travelling allowance or the value 
of any travelling concession or a contribution paid by the employer of a workman towards any pension or 
provident fund or a sum paid to a workman to cover any special expenses entailed on him by the nature of his 
employment. 
WORKMAN – Clause (n) of Section 2 
Any person (other than a person whose employment is of a casual nature and who is employed otherwise than 
for the purposes of the employer' s trade or business) who is a railway servant and not permanently employed in 
any administrative, district or sub- divisional office of a railway 
But does not include 
a) Any member of the Armed Forces of the Union 
b) Any reference to a workman who has been injured shall, where the workman is dead, include a reference to 
his dependants or any of them.
Industrial Employment (Standing Order) 
Act, 1946 
WAGES – CLAUSE (i) OF SECTION 2 
Definition of Wages is same as Clause (rr) of Section 2 of Industrial Disputes Act, 1947 
WORKERS – Clause (i) of Section 2 
Definition of Workers is same as Clause (s) of Section 2 of Industrial Disputes act, 1947
Payment of bonus act,1965 
WAGES – CLAUSE (21) OF SECTION 2 
All remuneration (other than remuneration in respect of overtime work) capable of being expressed in terms of money, 
which would, if the terms of employment, express or implied, were fulfilled, be payable to an employee in respect of his 
employment or of work done in such employment and includes dearness allowance (that is to say, all cash payments, by 
whatever name called, paid to an employee on account of a rise in the cost of living), But does not include - 
(i) any other allowance which the employee is for the time being entitled to; 
(ii) the value of any house accommodation or of supply of light, water, medical attendance or other amenity or of any 
service or of any concessional supply of food grains or other articles; 
(iii) any travelling concession; 
(iv) any bonus (including incentive, production and attendance bonus) 
(v) any contribution paid or payable by the employer to any pension fund or provident fund or for the benefit of the 
employee under any law for the time being in force; 
(vi) any retrenchment compensation or any gratuity or other retirement benefit payable to the employee or any ex 
gratia payment made to him; 
(vii) any commission payable to the employee 
WORKERS – Clause (13) of Section 2 
Any person (other than an apprentice) employed on a salary or wage not exceeding three thousand and five hundred 
rupees per mensem in any industry to do any skilled or unskilled manual, supervisory, managerial, administrative, 
technical or clerical work for hire or reward whether the terms of employment be express or implied

  • 3. EPF & Miscellaneous Provision Act, 1952 WAGES – Clause (b) of Section 2 "Basic wages” means all emoluments which are earned by an employee while on duty or on leave or on holidays with wages in either case in accordance with the terms of the contract of employment and which are paid or payable in cash to him. But does not include i.The cash value of any food concession; ii.Any dearness allowance (that is to say, all cash payments by whatever name called paid to an employee on account of a rise in the cost of living), House rent allowance, Overtime allowance, Bonus, Commission or any other similar allowance payable to the employee in respect of his employment or of work done in such employment. iii.Any presents made by the employer; EMPLOYEE – Clause (f) of Section 2 Any person who is employed for wages in any kind of work, manual or otherwise, in or in connection with the work of an establishment and who gets his wages directly or indirectly from the employer, and includes any person,- (i)employed by or through a contractor in or in connection with the work of the establishment; (ii)engaged as an apprentice, not being an apprentice engaged under the Apprentices Act, 1961 (52 of 1961) or under the standing orders of the establishment
  • 4. EMPLOYEES’ STATE INSURANCE ACT, 1948 WAGES – Clause (22) of Section 2 All remuneration paid or payable in cash to an employee, if the terms of the contract of employment, express or implied, were fulfilled and includes any payment to an employee in respect of any period of authorized leave, lock-out, strike which is not illegal or layoff and] other additional remuneration, if any, (paid at intervals not exceeding two months). But does not include — (a) any contribution paid by the employer to any pension fund or provident fund, or under this Act ; (b) any travelling allowance or the value of any travelling concession ; (c) any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment ; or (d) any gratuity payable on discharge EMPLOYEE – Clause (9) of Section 2 Any person employed for wages in or in connection with the work of a factory or establishment to which this Act applies and-i. who is directly employed by the principal employer on any work of the factory or establishment whether such work is done by the employee in the factory or establishment or elsewhere ii.who is employed by or through an immediate employer on the premises of the factory or establishment or under the supervision of the principal employer or his agent on work which is ordinarily part of the work of the factory or establishment or which is preliminary to the work carried on in or incidental to the purpose of the factory or establishment iii.whose services are temporarily lent or let on hire to the principal employer by the person with whom the person whose services are so lent or let on hire has entered into a contract of service
  • 5. THE FACTORIES ACT, 1948 WORKERS – Clause (L) of Section 2 Worker means a person employed a)directly or through any agency (including a contractor) with or without the knowledge of the principal employer whether for remuneration or not b)in any manufacturing process, or in cleaning any part of the machinery or premises used for a manufacturing process, c)in any other kind of work incidental to, or connected with the manufacturing process, or the subject of the manufacturing process But does not include -- Any member of the armed forces of the Union;
  • 6. INDUSTRIAL DISPUTES ACT, 1947 WAGES – CLAUSE (rr) OF SECTION 2 All remuneration capable of being expressed in terms of money, which would, if the terms of employment, expressed or implied, were fulfilled, be payable to a workman in respect of his employment or of work done in such employment, and includes-- (i) such allowances (including dearness allowance) as the workman is for the time being entitled to; (ii) the value of any house accommodation, or amenities (iii) any travelling concession; (iv) any commission payable on the promotion of sales or business or both. But does not include -- (a) any bonus; (b) any contribution paid or payable by the employer to any pension fund or provident fund or for the benefit of the workman under any law for the time being in force; (c) any gratuity payable on the termination of his service WORKMAN – Clause (s) of Section 2 Any person (including an apprentice) employed in any industry to do any manual, unskilled, skilled, technical, operational, clerical or supervisory work for hire or reward, whether the terms of employment be express or implied. But does not include any such person-- i.who is subject to the Air Force Act, 1950 (45 of 1950), or the Army Act, 1950 (46 of 1950), or the Navy Act, 1957 (62 of 1957) ii.who is employed in the police service or as an officer or other employee of a prison iii.who is employed mainly in a managerial or administrative capacity iv.who, being employed in a supervisory capacity, draws wages exceeding one thousand six hundred rupees per exercises.
  • 7. Minimum Wages Act,1948 WAGES – Clause (h) of Section 2 All remuneration capable of being expressed in terms of money which would if the terms of the contract of employment express or implied were fulfilled be payable to a person employed in respect of his employment or of work done in such employment and includes house rent allowance But does not include - (i)The value of supply of light, water, medical or other amenities (ii)Any contribution paid by the employer to any person fund or provident fund or under any scheme of social insurance (iii)Any traveling allowance or the value of any traveling concession (iv)Any sum paid to the person employed to defray special expenses entailed on him by the nature of his employment; (v)Any gratuity payable on discharge EMPLOYEE – Clause (i) of Section 2 Any person who is employed for hire or reward to do any work, skilled or unskilled, manual or clerical, in a scheduled employment in respect of which minimum rates of wages have been fixed; and includes a)An out-worker to whom any articles or materials are given out by another person to be made up, cleaned, washed, altered, ornamented, finished, repaired, adapted or otherwise processed for sale for the purposes of the trade or business b)An employee declared to be an employee by the appropriate Government But does not include - - Any member of the Armed Forces
  • 8. Gratuity Act,1972 WAGES – Clause (s) of Section 2 All emoluments which are earned by an employee while on duty or on leave in accordance with the terms and conditions of his employment and which are paid or are payable to him in cash and includes dearness allowance But does not include -- Any bonus, commission, house rent allowance, overtime wages and any other allowance. EMPLOYEE – Clause (e) of Section 2 Any person (other than an apprentice under Apprentices Act, 1961) employed 1.on wages in any establishment, factory, mine, oilfield, plantation, port, railway company or shop, to do any skilled, semi- skilled, or unskilled, manual, supervisory, technical or clerical work, whether the terms of such employment are express or implied 2.whether or not such person is employed in a managerial or administrative capacity, But does not include -- Any such person who holds a post under the Central Government or a State Government and is governed by any other Act or by any rules providing for payment of gratuity.
  • 9. Payment of Wages Act, 1936 WAGES – Clause (vi) of Section 2 All remuneration (whether by way of salary, allowance or otherwise) expressed in terms of money or capable of being so expressed which would, if the terms of employment, express or implied, were fulfilled, be payable to a person employed in respect of his employment or work done n such employment, and includes:- 1. any remuneration payable under any award or settlement between the parties or orders of a court 2. any remuneration in respect of overtime work or holidays or any leave period 3. any additional remuneration (whether called a bonus or by any other name) 4. any sum to which the person is entitled under any scheme framed under any law for the time being in force But does not include- 1. any bonus, profit-sharing or otherwise which does not form part of the remuneration payable 2. value of any house accommodation or other amenity or any service excluded from the computation of wages 3. any contribution paid by the employer to any pension or provident fund 4. any traveling allowance 5. any sum paid to defray special expenses entitled on him by the nature of his employment 6.any gratuity payable
  • 10. Contract Labour Act, 1970 WAGES – Clause (h) of Section 2 Definition of Wages is same as Clause (vi) of Section 2 of Payment of Wages Act, 1936 WORKMAN – Clause (i) of Section 2 Any person employed in or in connection with the work of any establishment to do any skilled, semiskilled or un-skilled manual, supervisory, or clerical work for hire or reward, whether the terms of employment be express or implied, But does not include any such person-- (A)who is employed mainly in a managerial or administrative capacity; or (B)who, being employed in a supervisory capacity draws wages exceeding five hundred rupees per exercises, either by the nature of the duties attached to the office or by reason of the powers vested in him, functions mainly of a managerial nature; or (C)who is an out-worker, that is to say, a person to whom any articles or materials are given out by or on behalf of the Principal employer to be made up, cleaned, washed, altered, ornamented, finished, repaired, adapted or otherwise processed for sale for the purposes of the trade or business of the principal employer and the process is to be carried out in the home of the out-worker or in some other premises, not being premises under the control & management of the principal employer.
  • 11. Workmen' S Compensation Act, 1923 WAGES – Clause (m) of Section 2 Any privilege or benefit which is capable being estimated in money other than a travelling allowance or the value of any travelling concession or a contribution paid by the employer of a workman towards any pension or provident fund or a sum paid to a workman to cover any special expenses entailed on him by the nature of his employment. WORKMAN – Clause (n) of Section 2 Any person (other than a person whose employment is of a casual nature and who is employed otherwise than for the purposes of the employer' s trade or business) who is a railway servant and not permanently employed in any administrative, district or sub- divisional office of a railway But does not include a) Any member of the Armed Forces of the Union b) Any reference to a workman who has been injured shall, where the workman is dead, include a reference to his dependants or any of them.
  • 12. Industrial Employment (Standing Order) Act, 1946 WAGES – CLAUSE (i) OF SECTION 2 Definition of Wages is same as Clause (rr) of Section 2 of Industrial Disputes Act, 1947 WORKERS – Clause (i) of Section 2 Definition of Workers is same as Clause (s) of Section 2 of Industrial Disputes act, 1947
  • 13. Payment of bonus act,1965 WAGES – CLAUSE (21) OF SECTION 2 All remuneration (other than remuneration in respect of overtime work) capable of being expressed in terms of money, which would, if the terms of employment, express or implied, were fulfilled, be payable to an employee in respect of his employment or of work done in such employment and includes dearness allowance (that is to say, all cash payments, by whatever name called, paid to an employee on account of a rise in the cost of living), But does not include - (i) any other allowance which the employee is for the time being entitled to; (ii) the value of any house accommodation or of supply of light, water, medical attendance or other amenity or of any service or of any concessional supply of food grains or other articles; (iii) any travelling concession; (iv) any bonus (including incentive, production and attendance bonus) (v) any contribution paid or payable by the employer to any pension fund or provident fund or for the benefit of the employee under any law for the time being in force; (vi) any retrenchment compensation or any gratuity or other retirement benefit payable to the employee or any ex gratia payment made to him; (vii) any commission payable to the employee WORKERS – Clause (13) of Section 2 Any person (other than an apprentice) employed on a salary or wage not exceeding three thousand and five hundred rupees per mensem in any industry to do any skilled or unskilled manual, supervisory, managerial, administrative, technical or clerical work for hire or reward whether the terms of employment be express or implied
