The FDA has 60 days to

The Prescription Drug User Action

Epidiolex will likely be fast tracked.

Note: If the DEA reschedules (to Schedule

Largest source of U.S. imports of hemp seed and oilcake
16,417 registered acres.

Purchasing viable seed for germination can be a complicated process. It can be difficult to locate a seed source, since there are no U.S. cultivars, and any seed must be sourced internationally. Also, the grower must submit a DEA 357 import form, and any seed source must be pre-screened by DEA and also meet USDA phytosanitary rules. Once the permit is obtained, a copy of the permit is then sent to the seed supplier and may be shipped by air freight.14 Other requirements include entry approval and ground transport to field sites and field site security.
Most hemp seed cultivars originate in the EU (mostly from France, Germany, Hungary, Italy, Poland, and Romania), Russia, Ukraine, and China
Total production across all European countries is reported at nearly 250 million pounds on more than 70,000 acres, accounting for about two-thirds of the U.N.-reported global production. Most of this production is in Western Europe. The European Union (EU) has an active hemp market, with production in most member nations
Canada:
In 2016, Health Canada1 reported 76,333 registered acres2 of hemp within the country and while this figure represented officially registered acres and not planted acres, it still places Canada as one of the largest hemp producing countries in the world.
Of the 76,333 registered acres, fewer acres will likely be harvested because there can be instances of crop failure and not all registered allotments are actually even planted. Assuming around two-thirds of registered acres are harvested produces an acreage estimate of 50,888.
This results in 666 kg of dry byproduct per acre. Canadian hemp varieties are bred exclusively for their grain and as a result have a low concentration of CBD at around only 1%-2% on a dry weight basis with certain varieties having slightly more. Using this range of concentrations results in a yield of 6.66 -13.32 kg of CBD per acre presently in Canada.
For the farmers, the crop is green gold – hemp brings in more than 10,000 yuan (US$1,500) per hectare, compared to just a few thousand yuan for more common crops like corn. It also has few natural enemies so there’s little need for expensive pesticides.

Estimates from other sources have begun circulating as CBD popularity has increased in recent years. A recent paper published by the Canadian Hemp Trade Alliance4 (CHTA) regarding the legal status of CBD extraction in Canada stated that “a field of hemp is estimated to produce over 12 kg CBD per hectare”5 (4.86 kg per acre). Using this yield estimate along with the number of harvested acreages produces a potential CBD production of 247,315 kg of CBD if current crops were extracted for their CBD contents.
Considering that CBD extraction is currently prohibited in Canada, little research is conducted on CBD yields within the country. However, research institutes within the United States are beginning to conduct these trials. As one of the first institutions in the United States to launch hemp agronomic research projects, the University of Kentucky is one of the leaders when it comes to industrial hemp. While the growing conditions in Kentucky are different to those in Canada these scientific studies can help provide another estimate on potential CBD yields. David Williams, professor of plant and soils at the University of Kentucky and lead researcher in their industrial hemp program, noted that early, non-replicated information indicates yields of around 500 lbs6 of dry, high CBD plant material per acre with an average CBD concentration of 5%.7 This figure equates to 227 kg per acre of dry plant material which results in a yield of 11.35 kg of CBD per acre. While these results are early and need time for replication, they can give another estimation of potential CBD yields in North America. Applying this estimation to the Canadian hemp acreage gives a potential Canadian CBD harvest of 577,579 kg.
that 67% of acreage, or 11,000 acres of the more than 16,000 registered acres, is being harvested this year.
Industrial hemp can be grown for a variety of purposes, with the three most notable being for seed, fiber, and CBD. Not all of the 11,000 harvested acres are dedicated to CBD production. Consequently, the percentage of acreage that is dedicated to CBD also needs to be estimated. Last year 45% of harvested acres were purely for CBD, however that number has gone up in 2016 with around 60% of hemp production being devoted to CBD - about 6,600 acres.
Altogether, this yields a domestic production estimate of 143,880 kilograms, to which we add an estimated 24,726 kilograms of imported CBD. The import estimates are drawn from surveys of industry participants. Accordingly, the total estimate of the deliverable supply of CBD is 168,606 kilograms.

(3) viable whole seed, capable of germination under suitable conditions.
