相較於一般條約須交由參議院以三分之二的多數進行同意，美國對外貿易談判多透過國會授權的法案，以比較便捷快速的方式讓經貿協議可以透過比較快速的程序進行締結。法案中國會會設定談判目標，透過法案的方式國會授權總統或行政部門進行接下來的談判，行政部門便因此而獲得特別磋商權。接著，在談判磋商完畢後，總統在簽署條約前必須在簽署前90天通知兩國會以及其他相關部會或是委員會等，此次通知必須以書面為之。爾後，在簽署後約文還必須交給兩國會去審理，讓國會研擬應如何將該約文制定成國內法律。而國會於此時，則不得將約文的文本有任何修改或是杯葛，只有「全部通過」或是「全部否決」這二個選項可以選擇。若國會否決，則必須重新由參議院以三分之二多數之同意始得通過。閱讀原文：http://popularintllaw.wordpress.com/2014/04/12/他山之石：美國怎麼監督經貿協定的締結呢？/#more-188
