The Minnesota Bureau of Criminal Apprehension was requested to investigate an officer involved shooting in Winona County. Chase Kolstad had been reported missing and suicidal by his friends. He had threatened suicide by firearm previously. On September 15th at 12:25 am, Deputy John Hazelton fatally shot Kolstad after Kolstad produced and pointed a weapon at Deputies Hazelton and Cichosz during an encounter on a bridge. Kolstad was pronounced dead at the scene. The BCA was investigating the circumstances of the shooting.

9. On 9-15-11 at approximately 1:10 AM, the MN BCA was requested by the Winona County Sheriff’s Office to
conduct an investigation into an Officer Involved Shooting occurring at approximately 12:25 AM in
Minnesota City located in Winona County.
SA Schafer spoke with Winona County Sheriff Dave Brand by phone who advised Deputy John Hazelton
had fired his department issued weapon once at Chase KOLSTAD after KOLSTAD had produced and
pointed a weapon at Deputies Hazelton and Chris Cichosz. Deputy Hazelton and Deputy Cichosz had been
removed from the scene. KOLSTAD was pronounced dead and remained at the scene. Deputy Hazelton’s
weapon had been secured in Deputy Cichosz’s squad at the scene.
SA Schafer along with SSA Evans, SAIC Hansen and SA Mueller responded to Minnesota City. The BCA
CST headed by Mark Patterson and assisted by SA Hanegraaf and other CST personnel also responded to
process the scene.
At the scene and later at the LEC, SA Schafer was briefed by Sheriff Brand and other law enforcement
personnel. SA Schafer was advised since approximately 5:07 PM on 9-13-11, Winona PD, Goodview PD, and
the Winona County SO have been attempting to locate KOLSTAD as it had been reported he was missing
and suicidal by his friends.
At the time of the initial missing person report, KOLSTAD’s mother, Kelly Laak, advised WPD KOLSTAD
has made previous threats of suicide including at least once threatening use of a firearm. Laak also reported
KOLSTAD is using prescribed and illegal drugs, including a synthetic drug referred to as plant food. Until
recently, KOLSTAD had been staying at Sarah Gibbs’ residence.
After immediate attempts to located KOLSTAD were unsuccessful, Winona PD entered KOLSTAD in NCIC
as a missing person. Continued searching on 9-13-11 and 9-14-11 did not produce KOLSTAD. Winona
Police drafted an internal Officer Safety memo advising KOLSTAD is missing/wanted, may be in possession
of a firearm, and is a known plant food user. The memo was posted and distributed internally to both the
Winona PD and Winona SO staff. SA Schafer acquired a copy of the memo and is identified as item 787.1
and is attached to this report.
On 9-14-11, at 10:51 PM, Sarah Gibbs reported to the Winona PD that she and Cullen Frisch were receiving
threatening messages from Chase KOLSTAD. Gibbs told WPD KOLSTAD stated he was in possession of a
handgun and wanted to kill Frisch while Gibbs watched. KOLSTAD also stated he would kill any law
enforcement officer that confronted him. While taking the report, KOLSTAD had called Gibbs and in the
presence of WPD Officer Joyce, KOLSTAD was put on speaker phone. KOLSTAD stated he had a gun to
his head and he wanted to meet Gibbs, but if she brought Frisch, he would shoot Frisch. Investigation
showed KOLSTAD was making these calls from the Alyssa Mueller residence in Minnesota City. WCSO,
WPD, and GVPD responded to Minnesota City to locate KOLSTAD.

At approximately 12:11 AM on 9-15-2011, GVPD Officer Volkman and WCSO Deputy Hansen located
KOLSTAD in the ball diamonds/city park near the bridge in Minnesota City. As they maintained their
position to the east of the bridge, at 12:16 AM, WCSO Deputies Hazelton and Cichosz encountered
KOLSTAD as KOLSTAD took up a position on the middle of the west side of the bridge, on the outer ledge.
Deputies Hazelton and Cichosz took a position on the south side of the bridge, approximately 30 yards from
KOLSTAD. After an approximately 9 minute stand-off, at 12:25 AM, KOLSTAD pointed a weapon at
Deputies Hazelton and Cichosz. Deputy Hazelton fired his department issued AR-15 once at KOLSTAD.
KOLSTAD fell off the bridge into the grass below. Medical personnel pronounced KOLSTAD dead at the
scene.
10. During the stand-off, Chad Westby had driven up to KOLSTAD while on the bridge, exited his vehicle and
approached KOLSTAD. Westby was ordered off the bridge and was taken into custody. SA Schafer spoke
with Westby on 9-15-11. Please refer to report 787/3 for details of the interview.
The BCA CST collected four items of evidence, including Deputy Hazelton’s AR-15and a knife from
KOLSTAD’s person. Prior to being transported to the MRMEO for autopsy, CST Patterson located a white
envelope in KOLSTD’S inner jacket pocket with the writing “my suicide note by Chase Kolstad.” Patterson
also located a small white plastic bag with white powder residue and a spoon with additional white powder
residue. These items remained on KOLSTAD’S person pending autopsy. Please refer to CST Patterson’s
report for details of processing the scene.

16. On 9-15-2011 at 4:37 AM, SA Schafer and Mueller interviewed Winona County Deputy John Hazelton
relating to his actions and observations during an Officer involved shooting in Minnesota City. A CD
containing the audio of the interview is identified as Item 787/1.1. Deputy Hazelton also produced a sketch
of the scene, Item 787/1.2, and provided a urine sample, Item 787/1.3. The urine sample was submitted to the
lab by SA Schafer as Lab Item 8.
Prior to the interview, Deputy Hazelton met with MPPOA representative Paul Eng, who was also present
during the interview. Deputy Hazelton provided a signed BCA Criminal Investigation Warning and BCA
Consent for Chemical Testing which are attached to this report.
Deputy Hazelton stated he has been a POST licensed officer for 10 years, all of which has been with the
Winona County Sheriff’s Office. Deputy Hazelton is currently a sniper on the Emergency Response Unit.
Deputy Hazelton is assigned to the 5:00PM to 3:00 AM shift and is currently in his third work day of his
week. Deputy Hazelton works in a fully marked squad in full uniform and his call number is 513. Part of
Deputy Hazelton’s department issued equipment includes an.223 caliber model AR-15 rifle which is kept
secured in his squad.
Deputy Hazelton explained he was aware of recent law enforcement contacts with Chase KOLSTAD and had
viewed a memo from 9-14-2011 advising that KOLSTAD was suicidal, a suspected drug user, and possibly in
possession of a handgun.
At approximate 11:30 PM on 9-14-11, Deputy Hazelton was advised to phone into dispatch. Hazelton was
advised that KOLSTAD is calling from the Alyssa Mueller residence in Minnesota City. Hazelton was
further advised KOLSTAD was armed with a handgun and was threatening to harm himself and others and
was heading to the park. Hazelton, along with other law enforcement, are told KOLSTAD has a scanner and
to utilize cell phones to communicate with one-another.
Deputy Hazelton headed towards Minnesota City from Winona and called Goodview PD Officer Volkman as
Goodview is located between Winona and Minnesota City. Hazelton and Volkman agree to meet after
Volkman gets night vision equipment. They agreed to meet off the main road away from the park as they did
not want to announce their presence as they are concerned they could be ambushed by KOLSTAD.
Deputy Hazelton and Officer Volkman are met by Deputy Brand and they park their squads at the south exit
on hwy 61, Bridge Street, at Minnesota City. All three approached the area on foot, utilizing the night vision
to locate KOLSTAD. Deputy Hansen arrives and the four are now at the railroad bridge to the south of the
park over Bridge Street and are unable to locate KOLSTAD.
Deputy Brand and Officer Volkman remain at the railroad bridge as Hazelton and Hansen go back to their
squads. Back at the squads, they are met by Deputy Cichosz. Between them, they feel KOLSTAD has not
made it to the park and may still be at Mueller’s residence. They plan to proceed to Mueller’s residence to
set up a perimeter, make contact with KOLSTAD, and contact a negotiator to speak with and resolve the
situation with KOLSTAD.
Prior to leaving, Officer Volkman announces over the radio that he has spotted a person in the park.
Volkman and Deputy Brand maintain their position near the railroad bridge. Deputy Hazelton and Cichosz
advise they will approach the area in Cichosz’s squad “blacked out.” Deputy Hazelton takes his duty rifle
from his squad.
As Hazelton and Cichosz approach, Cichosz turns on the squad spotlight to assist in locating the subject.
Officer Volkman advises the subject is couching, avoiding the spotlight. Hazelton and Cichosz continue to
approach on Bridge Street and as they near the bridge from the south end, they see a subject about halfway
down the bridge, on the west side outer ledge.
The deputies park and leave the squad, keeping the spotlight on the subject. Deputy Hazelton takes up a
kneeling position on the south end of the bridge, west side, behind a sign with his rifle sighted on the
17. subject. Deputy Cichosz is standing directly behind Hazelton. Hazelton and Cichosz repeatedly shout
commands for the subject to show his hands. The subject does not comply or acknowledge the deputies.
As they continued to shout commands, a vehicle drove onto the bridge from the north end and stopped
near the subject. The vehicle headlights were pointed at Hazelton and Cichosz, hindering their vision. The
driver, Chad Westby, exited the vehicle as Hazelton and Cichosz shouted commands for the driver to get
into his vehicle and leave the area. The driver complied and the vehicle drove south past the deputies. The
vehicle was eventually stopped by other officers and Westby was detained and ultimately arrested.
Hazelton and Cichosz continued to focus on the subject and shout verbal commands for the subject to
show his hands. Hazelton observed the subject was reaching into his jacket pocket and pulled out a
handgun. Cichosz confirmed it was a gun and that information was broadcast to the officers at the scene.
Hazelton and Cichosz advised the assisting officers not to position themselves on the immediate north end
of the bridge to avoid a cross-fire situation and to shut down Bridge Street to traffic.
The subject was holding the gun in his right hand and was placing it directly under his chin pointing the
end upwards. The subject was also placing the gun against this temple and placing it inside his mouth. As
the subject placed the gun again under his chin, Deputy Hazelton felt certain the subject was going to shoot
himself. Deputy Hazelton shouted at the subject, “don’t do it!, don’t do it!, drop the gun!, drop the gun!”
The subject put the gun back to his head and then began to wave it around, pointing it in the direction of
the north end of the bridge. Deputy Hazelton said the residences of Minnesota City are located just north
of the bridge and other officers were in the general area, however Hazelton did not discharge his weapon as
he did not identify an immediate threat.
The subject then bought the gun back to his head and then brought it down, pointing it directly at Hazelton
and Cichosz. Deputy Hazelton though the subject was going to shoot at them. Hazelton explained he was
in fear of his life and Deputy Cichosz who was directly behind and above Hazelton. As the subject kept the
weapon pointed at the deputies, Hazelton said he was certain if Hazelton did not shoot, they would be shot
by the subject.
Deputy Hazelton then fired one round and the subject fell off the bridge to the ground below. Dispatch and
other officers were advised of the “shots fired”. Hazelton and Cichosz approached from the top of the
bridge as others approached the subject from below. Hazelton and Cichosz remained on the bridge until
medical personnel pronounced the subject dead at the scene.
Deputy Hazelton said the incident on the bridge lasted approximately 4-5 minutes. Hazelton added the entire
time the subject never spoke or complied with any commands.
Hazelton secured his rifle in Deputy Cichosz’s squad and both cleared the scene.

24. On 9-15-2011 at 5:45 AM, SA Schafer spoke with Winona County Deputy Chris Cichosz concerning his
actions and observations relating to an Officer Involved Shooting with Chase KOLSTAD. A CD containing
the audio of the interview is identified as Item 787/2.1. Deputy Cichosz also produced a sketch of the scene,
identified as Item 787/2.2.
Deputy Cichosz stated he has been a POST licensed officer for 9.5 years, all of them with the Winona
County Sheriff’s Office. Cichosz is a K-9 handler and works from 5:00 PM to 3:00 AM and his call number is
518. 9-14-11 was his first day back at work, however he and his K-9 had been requested on 9-13-11 to assist
in the search for Chase KOLSTAD, who was reported as a suicidal male with a gun. Cichosz was not able to
search for KOLSTAD at that time.
Cichosz was working in a fully marked SUV in full uniform when dispatch advised him to call in. Dispatch
advised Cichosz that KOLSTAD was in the Minnesota City area. KOLSTAD was reported to be suicidal
and in possession of a gun and a scanner. Cichosz was also told KOLSTAD had made death threats to law
enforcement and others.
Cichosz proceeded to Minnesota City and met up with other deputies on the south highway 61/Bridge
Street exit. Deputies Hazelton and Hansen were coming back to the squads from the north. As Cichosz
arrived, GVPD Volkman radioed he spotted a subject in the park. WPD Sgt Allen called by cell phone and
advised the observed subject could also be Chad Westby who may be with KOLSTAD.
Volkman advised the subject was moving towards the bridge. Deputy Cichosz and Deputy Hazelton took
Cichosz’s squad and proceeded on Bridge Street, north, to the park. As they got closer to the park, Cichosz
turned on his squad headlights and spot light.
As they neared the south end of the bridge, Cichosz and Hazelton spotted a subject about half-way down
the bridge, on the west side outer ledge. Cichosz parked at the south end, west side and he and Hazelton
took cover at the end of the bridge, about 30-40 yards from the subject. Hazelton was kneeling and holding
his duty rifle sighted on the subject and Cichosz was standing behind Hazelton.
Deputies Cichosz and Hazelton began to shout commands at the subject to drop the gun. Cichosz explained
he did not see a gun at this time, but it was believed the subject possessed a gun. The subject did not
respond.
As Deputy Hazelton continued to give commands to the subject, Cichosz saw a gun in the subject’s right
hand. Cichosz explained the subject was gripping the weapon like a gun and at one point held it up under
his chin with both hands and Cichosz thought he was going to shoot himself.
Cichosz said as the subject waved the weapon around, it flashed in the light and Cichosz described it as a
chrome handgun. Cichosz said he could see the subject holding the grip of the weapon with the shiny metal
barrel perpendicular to the grip and pointed outwards, parallel with the subject’s arm.
As Cichosz and Hazelton continued to shout commands, a truck approached from the north, with its
headlights shining at Cichosz and Hazelton making it difficult for the deputies to see and illuminating them,
putting them at a tactical disadvantage. Cichosz said the truck stopped where the subject was and the
driver exited. Cichosz recognized the driver as Chad Westby. Cichosz said as Westby approached the
subject, it seemed to agitate the subject. Westby was ordered to get back in the truck and leave the area.
Westby left the bridge and was detained by other officers.
Deputy Cichosz noticed that Officer Volkman and Deputy Brand had now joined him and Hazelton, taking
cover behind a large rock behind them.
Cichosz said Hazelton remained on target with the subject as Cichosz gave commands to drop the gun.
Hazelton also continued to give commands to drop the gun, adding “it can’t be that bad.” Cichosz said the
25. subject laughed at that statement. Cichosz said that was the only time the subject had said anything or
acknowledged the deputies.
At that point, Cichosz said based on the subject’s actions and their observations, he and Hazelton were
confident the weapon was a gun.
Cichosz then advised dispatch to contact a negotiator to come to the scene. Cichosz stated he had turned
around to tell Volkman and Brand to set up a perimeter at the north end of the bridge. Cichosz said as he
turned around, Hazelton shot once. Cichosz turned back to see the subject had fallen off the bridge.
After the subject was pronounced dead, Cichosz was removed from the scene. His squad remained parked
at the scene.

30. On 9-15-2011 at 8:58 AM, SA Schafer spoke with Chad Westby concerning his actions and observations
relating to an Officer Involved Shooting with Chase KOLSTAD. A CD containing the audio of the interview
is identified as Item 787/3.1.
Westby had been arrested earlier on 9-15-2011 on charges relating to the OIS. Prior to SA Schafer speaking
with Westby, he had been released from custody.
Westby said he and KOLSTAD were best friends and had gone through treatment together. Westby was
aware KOLSTAD had made prior threats of suicide by hanging or overdosing. Westby has heard from
KOLSTAD he claimed to have possession of a .38 handgun; however, Westby does not believe KOLSTAD
had a gun.
Westby said KOLSTAD does have “a little pocket knife” and described it as a 4-6 inch silver folding blade
and was unable to describe the handle. Westby was aware KOLSTAD was a “plant food” user and had
overdosed on plant food earlier in the month.
Westby said KOLSTAD has “really gone downhill” the past few days, adding he has never seen KOLSTAD
so depressed. Westby felt mostly because KOLSTAD had recently broken up with Sarah Gibbs and she
has a new boyfriend, Cullen Frisch. Westby also told SA Schafer within the past two weeks, he has had
sexual relations with Gibbs. On 9-13-2011, KOLSTAD learned of Westby and Gibbs from Gibbs. Westby
explained to SA Schafer though he thought KOSTAD learning of that incident did not “put KOLSTAD over,
it did not help.”
On 9-13-2011, Westby had been looking for KOLSTAD for over five hours as KOLSTAD has been
depressed and they could not locate him. Westby and KOLSTAD had talked on the phone and KOLSTAD
said he was going to hang himself. According to Westby, KOLSTAD said he had 240 milligrams of
oxycontin and one gram of meth. Westby was on the phone with KOLSTAD when KOLSTAD said he was
actually shooting the drugs all at once as they spoke. Westby said KOLSTAD said “oh shit!” and then
KOLSTAD dropped the phone. Westby though he had died at that point.
Later in the evening on 9-13-2011, After calling the police and asking for help in locating KOLSTAD,
Westby said he had spoke with WPD Officer Sobotta and told her KOLSTAD was found and is OK but
would not advise police where KOLSTAD was.
Westby said the last he actually saw KOLSTAD was at approximately 1:00 PM on 9-14-2011 when he and
KOLSTAD had gone grocery shopping for Alyssa Mueller. Westby said they were together for about 2 ½
hours. Westby said he did have two or three short conversations with KOLSTAD about 2-4 hours before
seeing KOLSTAD on the bridge. KOLSTAD told Westby “he had a plan.”
Westby sad he had been driving around in Minnesota City for about an hour before seeing KOLSTAD on
the bridge and he parked near the bridge and park area. Westby called the Winona Police number to tell
someone where Westby was and wanted an officer to stop by so he could tell them what was going on with
KOLSTAD. Westby was told Officer Joyce could call him back and Westby, seeing a deputy nearby, asked
dispatch if the deputy could come over.
After the deputy did not come over, Westby the drove around towards the bridge and saw KOLSTAD
standing on the bridge and saw 15 police cars. Westby said as he approached, he saw Deputy Hazelton
with a shotgun and other officers at the opposite end of the bridge. Westby said he pulled up to KOLSTAD
who was standing on the outer ledge of the bridge and asked KOLSTAD to come down. Westby said he
held out his hand and KOLSTAD put his hand out to him. Westby said we was ordered off the bridge by
deputies, detained, and ultimately arrested.
Westby initially told SA Schafer as he pulled up to KOLSTAD, KOLSTAD was “not pointing the gun at
nobody else.” When SA Schafer asked for details about the gun, Westby said KOLSTAD did not have a
gun. When asked if KOLSTAD had any kind of weapon, Westby said KOLSTAD did not.
31. Westby said as he was in the back of a squad care, he heard over the radio that shots had been fired and the
subject was in the water. Westby said he was eventually transported to the Winona county jail and
booked.

38. On 9-22-2011 SA Schafer sought and was granted a search warrant for Facebook, Inc. for records relating to
Chase KOLSTAD. KOLSTAD Facebook ID was identified as “Chase E ntGuilty”, ID3282762546994. The
search warrant was reviewed and signed by Winona District Judge Mary Leahy.
On 10-1-2011, per Facebook guidelines, the search warrant was emailed to their headquarters located in Palo
Alto CA.
As of 11/7/2011 SA Schafer has not received a response from Facebook. Once received, it will be made a
part of the case file.

44. On 9-22-2011 at 10:12 AM, SA Schafer spoke with Eric Burfeind relating to a Facebook conversation he had
with Chase KOLSTAD. A CD containing the audio of the interview is identified as Item 787/8.1.
Eric Burfeind had approached the Winona County Sheriff’s Office advising he had information relating to
the officer involved shooting with Chase KOLSTAD.
Burfeind told SA Schafer on 9-14-2011, between the hours of 11:00 AM and 2:00 PM, Burfeind had a
conversation with KOLSTAD through Sasha Brinkmeier’s Facebook account. Brinkmeier is Burfeind’s
girlfriend. Burfeind stated he was using the account when KOLSTAD’s name appeared on the screen
requesting a conversation. During the conversation Burfeind did not identify himself he was uncertain in
KOLSTAD knew if he was writing to Burfeind or Brinkmeier. Brinkmeier was present during this exchange
with KOLSTAD.
In the five minute conversation, KOLSTAD stated he is “the proud new owner of a .38” and “he was going
to be take the gun wherever he goes.” KOLSTAD also said he has a list of three people who he is watching
and will be going after them to pay them back. Burfeind explained KOLSTAD never said he was going to kill
them, however, Burfeind stated because of his criminal background, he inferred KOLSTAD was going to kill
them.
Burfeind recalled one name on the list as “Sarah W’ and two males whose names he was unable to recall.
Burfeind also said KOLSTAD stated he was depressed as his girlfriend had left him and KOLSTAD had
been using a lot of “plant food”.
Burfeind stated he came forward and was concerned for the deputy. He usually does not approach the
police and offer information. Burfeind stated if SA Schafer contacted Brinkmeier, she would lie about the
Facebook conversation.
Burfeind stated his Facebook user name is “bowhunter55952”.

48. On September 15, 2011, SA Hanegraaf was contacted by the Bureau of Criminal Apprehension’s (BCA)
operations center to respond to a crime scene located at the “Bridge” on Bridge St./Wenonah Rd, in
Minnesota City, MN. Upon arrival SA Hanegraaf was briefed by SA Schafer regarding the crime scene. The
BCA Crime Scene Team (CST) responded to the scene as well. The BCA CST was comprised of Mark
Patterson as the team leader and Eric Grunwald, Katie Igowsky as team members.
SA Hanegraaf documented the crime scene through digital photography. These digital images were later
transferred to a master DVD, which was labeled item 9.1. The compact flash card was sent to the crime scene
section where a contact sheet and compact discs were made. Copies of the contact sheets and compact
discs will be given to SSA Evans to distribute.
SA Lehman also responded to the scene to assist in scene documentation. SA Lehman documented the
scene with video. This was recorded on a MiniDV, which was transferred to a DVD for easy viewing. The
MininDV has been labeled item 9.2.
The above items of evidence have been properly marked and will be stored within the crime scene files.

Item 787/11.1 was taken by Officer Joyce and are photos of Sara Gibbs’ cell phone text messages with
KOLSTAD from 9/13/2011.
Items 787/11.2 and 787/11.3 are squad videos of Winona PD Officers Lapham, Lanning, and Joyce
responding to the OIS in Minnesota City on 9/15/2011. None of the squad cameras captured the OIS due to
vehicle location and positioning. Some audio relating to individual officers are on the DVD.
Item 787/11.3 also contains video from Chad Westby being booked into the Winona county jail on
9/15/2011.
No video exists from any Winona County Sheriff’s squads at the scene. Deputy Cichosz’s squad is
equipped with video; however, the hard drive to the unit was removed prior to 9/15/2011 for repairs.
