1. The appellant Pushakar Raj Chandna had asked for copies of his Annual Confidential Reports (ACRs) from 2002-2006 from MECON Limited under the Right to Information Act, but they were denied under Section 8(1)(j).
2. During the hearing, the Central Public Information Officer stated that ACRs have traditionally been considered confidential documents.
3. However, the Central Information Commissioner ruled that government employees have the right to know their own performance evaluations and directed the CPIO to provide the ACR information to the appellant within 15 working days.

1. Both the parties were heard on 24/9/2010.
2. The appellant has asked for copies of ACRs for the period 2002 - 2006,
which have been refused to him u/s 8(1)(j) of the Act.
3. During the hearing, the CPIO stated that the ACRs have traditionally been
considered as confidential document and therefore the information was refused
to the appellant.
Decision:
4. Every government employee has the right to know his performance
evaluation and the grades obtained by him. Such information are helpful in
improving work performance. Therefore, there is no justification for withholding
ACR grades of employees.

2. 5. The CPIO is therefore directed to furnish the information asked for within
15 working days from the date of receipt of this decision failing which penalty
proceedings u/s 20(1) of the Act would be initiated.
6. The appeal is thus disposed of.
