Déclaration du Secrétaire Johnson regardant ses instructions
pour la reprise des déportations régulières vers Haiti
Après le tragique tremblement de terre qui a frappé Haïti le 12 janvier 2010, l’Agence
Américaine de l’Immigration et des Douanes (U.S. Immigration and Customs Enforcement -
ICE), avait temporairement cessé le processus de déportation de citoyens haïtiens vers Haiti. Le
1er avril 2011, l’ICE annonçait la reprise, sur une base limitée, des déportations d’Haïtiens qui
sont en possession d’une décision finale de déportation, ou reconnus coupables d’un crime
grave, ou qui représentent une menace à la sécurité nationale. Depuis lors, la situation en Haiti
s’est raisonnablement améliorée pour permettre au gouvernement américain de déporter les
citoyens haïtiens sur une base plus régulière, en accord avec les pratiques en vigueur pour les
ressortissants d’autres pays.
Hier, j’ai ordonné, et ceci immédiatement, que la mise en application de décisions
concernant les citoyens haïtiens soit en accord avec les pratiques en vigueur, conformément au
Mémorandum que j’ai signé le 20 novembre 2014, «Politiques pour l’Arrestation, la Détention
et la Déportation d’Immigrants Sans-Papiers». Ces règlements priorisent la déportation de
criminels condamnés ou ceux reconnus coupables de délits graves ou multiples, et d’individus
appréhendés au niveau des ports d’entrée au moment où ils essaient de rentrer illégalement aux
Etats-Unis d’Amérique.
Selon les lois en vigueur, les individus qui expriment une peur de retourner en Haiti
seront mis au triage par un officier traitant les questions d’asiles au sein du Service de la

2. Citoyenneté et de l’Immigration (U.S. Citizenship and Immigration Services - USCIS) pour
déterminer si leur peur de persécution et de torture exprimée est crédible. Ceux qui auront établi
une vraie peur seront référés au tribunal de l'immigration pour la procédure de déportation où ils
pourront faire une demande d’asile ou solliciter d’autres formes de bénéfices.
Les citoyens haïtiens qui sont actuellement couverts par le Statut de Protection
Temporaire (Temporary Protected Status - TPS) ne sont pas affectés par ce changement.
Spécialement, ces citoyens haïtiens résidant aux Etats-Unis de manière continue depuis le 12
janvier 2011, et qui ont actuellement le TPS peuvent demeurer aux Etats-Unis et ne sont pas
concernés. Ceux-là qui ont bénéficié du TPS restent également éligibles pour une autorisation
d’emploi. Le TPS a été prolongé jusqu’au 22 juillet 2017 pour les citoyens haïtiens.
Le Département de la Sécurité Territoriale des Etats-Unis (DHS), continuera à
promouvoir les moyens légaux et sécuritaires pour les ressortissants haïtiens désirant immigrer
aux Etats-Unis, y compris à travers le Programme de Réunification des Familles Haïtiennes
(Haitian Family Reunification Parole), qui permet à des personnes, dont la pétition de visa
d’immigrants a été approuvée, de rentrer aux Etats-Unis jusqu’à deux ans avant que la date
d’émission du visa soit effective.
Le DHS et le Département d’Etat travaillent avec le gouvernement haïtien et d’autres
partenaires clés pour reprendre les déportations de manière humaine et dans la plus grande
conformité que possible.

Statement by Secretary Johnson Concerning His Directive
to Resume Regular Removals to Haiti
Following the tragic January 2010 earthquake in Haiti, U.S. Immigration and Customs
Enforcement (ICE) temporarily ceased removing Haitian nationals to Haiti. On April 1, 2011,
ICE announced the resumption of removals on a limited basis of Haitians with final orders of
removal and convicted of a serious crime, or who posed a national security threat. Since that
time, the situation in Haiti has improved sufficiently to permit the U.S. government to remove
Haitian nationals on a more regular basis, consistent with the practice for nationals from other
nations.
Yesterday I directed that, effective immediately, enforcement decisions with respect to
Haitian nationals should be, consistent standard practice, guided by my memorandum dated
November 20, 2014, “Policies for the Apprehension, Detention and Removal of Undocumented
Immigrants.” These policies prioritize the removal of convicted felons, individuals convicted of
significant or multiple misdemeanors, and individuals apprehended at or between ports of entry
while attempting to unlawfully enter the United States.
Consistent with law, individuals who express a fear of return to Haiti will be screened by
a U.S. Citizenship and Immigration Services (USCIS) asylum officer to determine whether they
possess a credible fear of persecution or torture. Those determined to have a credible fear will

6. be referred to immigration court for removal proceedings where they may apply for asylum or
other forms of relief.
Haitian nationals currently covered by Temporary Protected Status are unaffected by this
change in policy. Specifically, those Haitian nationals who have been continuously residing in
the United States since January 12, 2011 and currently hold TPS may remain in the United
States and are not subject to removal. These TPS beneficiaries also remain eligible for
employment authorization. TPS for Haitian nationals has been extended through July 22, 2017.
DHS will continue to promote safe, orderly avenues for Haitian nationals seeking to
immigrate to the United States, including through Haitian Family Reunification Parole, which
allows certain beneficiaries of approved family-based petitions to be paroled into the United
States up to two years before their visa priority date becomes current.
DHS and the Department of State are working with the Government of Haiti and other
key partners to resume removals in as humane and minimally disruptive a manner as possible.
