8. Legal Aspects of Supervision
0 Direct liability would be charged when the actions of a supervisor were
themselves the cause of harm to a supervisee or a client (for instance, if a
supervisor suggested (and documented) an intervention that was
determined to be the cause of harm). The supervisor does not have to
actually carry out the intervention, but if the supervisee follows the
suggestion of a supervisor and this results in harm – this is direct liability.
0 Vicarious liability is being held liable for the actions of the supervisee
when these were not suggested, or even known, by the supervisor.
Therefore, if a supervisory relationship exists, the supervisor can
potentially be held liable for any negligent acts of the supervisee.

Read the Agenda aloud.First, let’s start off by defining supervision. Supervision is a process that involves a supervisor equipping a trainee with essential skills to perform a specific job (Corey, Schneider Corey, & Patrick, "Chapter 9, Introduction," 2011).
The style of the supervision is reflected with this questionsWhat do you want to say your client?How is your behavior affecting them?What is going on with you as you listen to your clients?Ethics code : address the standards for the supervision distinguish between personal therapy for the supervisee and the some unique functions of the clinical supervision.Goal: self- awareness responsibility threat Ethic code in general supervision should address personal concerns only to the extent that they may impede the supervisee’s ability to effectively work with clients.Note: Different types of leadership styles exist in work environments. Advantages and disadvantages exist within each leadership style. The culture and goals of an organization determine which leadership style fits the firm best. Some companies offer several leadership styles within the organization, dependent upon the necessary tasks to complete and departmental needs. leadership styles are more effect for team building, including participative and transformational leadership. Other leadership styles, including authoritarian and laissez faire, can be counterproductive and hinder the functions of teams. Your role has to be only of a supervisor, not as a buddy to go bar hopping, going to Mexicali, or start any intimate relationship. Sexual Relationship Is prohibited between supervisor and trainee.In order to be a professional, you have to act as a professional supervisor.There will be times:Were you will occasionally see your client or your supervisee, you could be polite say hello. And move on.When you don’t cross the boundaries you are helping, yourself in becoming involve in ethical issues.
Supervisors function within multiple roles. An example of how a supervisor can fulfill several different roles during a single session with a supervisee would be: To instruct the supervisee in a clinical approach (Teacher) Consult on how to intervene with the client (Consultant) Counsel the supervisee with feelings towards the client (Counselor) Giving evaluative feedback to the supervisee on their progress (Evaluator) When a supervisor is operating in more than one role, they need to be aware of what role they are operating in, why they are implementing that role and what is the desired outcome for that supervisee.(Corey, Schneider Corey, & Patrick, "Chapter 9, Supervisor’s Roles and Responsibilities," 2011)

The supervisors job is to be in constant communication with the supervisee.When you are meeting that goal , you will be able to notice any negative changes, any problems that could arise with the client..When you do so, you will be protecting yourself as a supervisor , supervisee and the client as well..In order to be professional, you have to act as a professional supervisor.Don’t be involve any type of romantic relationship or dual role.You have the obligation to report : Duty to warn, and Duty to protect.

If the employer may feel that the supervisor does not care ,or will bother to understand their culture which will in turn possible cause them to not put away the effort like inadequate morale, Employer will do things she/he normally would not do because of the fear he/she being questioned

The goal of a supervisor is to maintain the wellness of the current and future clients of the supervisees while forming the foundation in which the supervisees will build upon as they develop and maintain excellent skills through proper training, education and supervised experiences that will allow the supervisees to provide ethical and effective services to their clients.(Corey, Schneider Corey, & Patrick, "Chapter 9, Supervisor’s Roles and Responsibilities," 2011)A supervisee is a direct reflection of his/her supervisor. At some point, we will all be supervisees and some will graduate to supervisors, what type of reflection will you reflect when you step into one or both of these roles?????
