Summary of the act


This act came into force on May 8th , 1955.



It extends to the whole of India.



An Act to prescribe punishment for the
preaching and practice of “untouchability”
and for the enforcement of any disability
arising there from and for matters connected
therewith.

Civil rights means any right accruing to a
person by reason of the abolition of “
untouchability” by article 17 of constitution.
ARTICLE 17
Abolition of Untouchability - “Untouchability’’
is abolished and its practice in any form is
forbidden. The enforcement of any disability
arising out of “Untouchability’’ shall be an
offence punishable in accordance with law.

For enforcing religious
disabilities


Whoever on the ground of “untouchability”
prevents any person
- from entering any place of public worship
which is open to other persons professing the
same religion or any section.
- from worshipping or offering prayers or
performing any religious service in any place
of public worship, or bathing or using the
waters of, any sacred tank, well, spring or
water-course.
For enforcing social
disabilities


Whoever on the ground of “untouchability”
prevents any person
- access to any shop, public restaurant, hotel
or place of public entertainment.
- the use of any utensils, and other articles
kept
in
any
public
restaurant, hotel, dharmshala.
- the practice of any profession or the carrying
on of any occupation, trade or business or
employment in any job

ghat, burial or cremation ground, any sanitary
convenience, any road, or passage, or any
other place of public resort.

conveyance.
For refusing to admit person to
hospitals etc


Refuses admission to any person to any
hospital dispensary, educational institution or
any hostel.



Does any act which discriminates against any
such person after admission to any of the
aforesaid institution.
For refusing sale of goods or
services


Whoever on the ground of “untouchability”
refuses to sell any goods or refuses to render
any service to any person but at the same time
sells goods or render services to other persons
in the normal course of business.
Punishment for other offences
arising out of “untouchability”
Prevents any person from exercising any right
accruing to him by reason of the abolition of
“ untouchability” under article 17 of the
Constitution.
 Molests, injures, annoys, obstructs or causes
or attempts to cause obstruction to any person
in the exercise of any such right.
 By words, either spoken or written, or by signs
or by visible representations encourages any
person or the public generally to practice
“untouchability”



For the above said acts, the person is
punishable with an imprisonment of not less
than 1 months and not more than 6 months
and a fine of not less than Rs.100 and not
more than Rs.500
Unlawful compulsory labour


Whoever compels any person, on the ground
of “untouchability” to do any scavenging or
sweeping or to remove any carcass or to flay
any animal or to remove the umbilical cord or
to do any other job of a similar nature, shall be
punishable with an imprisonment of not less
than 3 months and not more than 6 months
and a fine of not less than Rs.100 and not
more than Rs.500
Cancellation or suspension of
licenses


When a person who is convicted of an offence
under the above sections, holds any license
any profession, trade, calling or employment
the court trying the offence may cancel or
suspend the license for time being.
Resumption or suspension of
grants made by government


Where the manager or trustee of a place of
public worship (or any educational institution
or hostel) which is in receipt of a grant of land
or money from the Government is convicted of
an offence under this Act, the government can
directly suspend such grants.
Limitation of jurisdiction of Civil
Courts


No Civil Court shall entertain or continue any
suit or proceeding related to this act.

Civil rights act

  • 1.
  • 2. Summary of the act  This act came into force on May 8th , 1955.  It extends to the whole of India.  An Act to prescribe punishment for the preaching and practice of “untouchability” and for the enforcement of any disability arising there from and for matters connected therewith.
  • 3. Cont… Civil rights means any right accruing to a person by reason of the abolition of “ untouchability” by article 17 of constitution. ARTICLE 17 Abolition of Untouchability - “Untouchability’’ is abolished and its practice in any form is forbidden. The enforcement of any disability arising out of “Untouchability’’ shall be an offence punishable in accordance with law. 
  • 4. For enforcing religious disabilities  Whoever on the ground of “untouchability” prevents any person - from entering any place of public worship which is open to other persons professing the same religion or any section. - from worshipping or offering prayers or performing any religious service in any place of public worship, or bathing or using the waters of, any sacred tank, well, spring or water-course.
  • 5. For enforcing social disabilities  Whoever on the ground of “untouchability” prevents any person - access to any shop, public restaurant, hotel or place of public entertainment. - the use of any utensils, and other articles kept in any public restaurant, hotel, dharmshala. - the practice of any profession or the carrying on of any occupation, trade or business or employment in any job
  • 6. Cont… -The use of, or access to any river, stream, spring, well, tank, cistern, watertap or other watering place or any bathing ghat, burial or cremation ground, any sanitary convenience, any road, or passage, or any other place of public resort. - the use of, or access to, any place used for a charitable or a public purpose. - the use of, or access to, any public conveyance.
  • 7. For refusing to admit person to hospitals etc  Refuses admission to any person to any hospital dispensary, educational institution or any hostel.  Does any act which discriminates against any such person after admission to any of the aforesaid institution.
  • 8. For refusing sale of goods or services  Whoever on the ground of “untouchability” refuses to sell any goods or refuses to render any service to any person but at the same time sells goods or render services to other persons in the normal course of business.
  • 9. Punishment for other offences arising out of “untouchability” Prevents any person from exercising any right accruing to him by reason of the abolition of “ untouchability” under article 17 of the Constitution.  Molests, injures, annoys, obstructs or causes or attempts to cause obstruction to any person in the exercise of any such right.  By words, either spoken or written, or by signs or by visible representations encourages any person or the public generally to practice “untouchability” 
  • 10.  For the above said acts, the person is punishable with an imprisonment of not less than 1 months and not more than 6 months and a fine of not less than Rs.100 and not more than Rs.500
  • 11. Unlawful compulsory labour  Whoever compels any person, on the ground of “untouchability” to do any scavenging or sweeping or to remove any carcass or to flay any animal or to remove the umbilical cord or to do any other job of a similar nature, shall be punishable with an imprisonment of not less than 3 months and not more than 6 months and a fine of not less than Rs.100 and not more than Rs.500
  • 12. Cancellation or suspension of licenses  When a person who is convicted of an offence under the above sections, holds any license any profession, trade, calling or employment the court trying the offence may cancel or suspend the license for time being.
  • 13. Resumption or suspension of grants made by government  Where the manager or trustee of a place of public worship (or any educational institution or hostel) which is in receipt of a grant of land or money from the Government is convicted of an offence under this Act, the government can directly suspend such grants.
  • 14. Limitation of jurisdiction of Civil Courts  No Civil Court shall entertain or continue any suit or proceeding related to this act.
