13. USA
• Federal hazardous waste rules set requirements based on
the amount of waste generated; less than 100kg per
month = Conditionally Exempt Small Quantity
Generator; between 100kg and 1,000kg = Small
Quantity Generator; greater than 1,000kg per month =
Large Quantity Generator;
• In Kansas, however, a Conditionally Exempt Small
Quantity Generator = less than 25kg per month; so a
facility that generates 50kg per month in Kansas is a
Small Quantity Generator, but a facility that generates
50kg per month in Illinois is a Conditionally Exempt Small
Quantity Generator; this is important because CESQG
have a reduced regulatory burden compared to SQG;
Example 1
14. USA
• USTs: federal regulations are listed at 40 CFR 280
(and 40 CFR 112 for petroleum products); certain
states are “delegated” the authority to enforce their
own standards so companies in those states just
have to comply with the one set of rules; other
states, such as New Jersey, have yet to receive such
authority so a facility with USTs in New Jersey must
meet both the federal set of rules and the state set
of rules; while they are VERY similar, they do
contain minor reporting and recordkeeping
differences;
Example 2
15. USA
• California is the only state in the US with an
ergonomic H&S standard; no federal OSHA
requirements;
• California has more stringent Permissible
Exposure Limits (PELs) for certain chemicals;
for example, acetone is a common solvent; CA’s
PEL is 500 parts per million (ppm), while federal
OSHA’s PEL is 1,000 ppm.
Example 3
17. AUSTRALIA
• Even if there is a trend towards harmonization :
Model work Health and Safety Act &
Commonwealth Work Health and Safety Act
• Not all states already follow federal rules right
now and specificities are numerous
Few details
19. GERMANY
HEALTH AND SAFETY
• General Regulations (federal) are completed by a set of
technical rules : recommendations and suggestions for
the compliance with regulatory requirements. They are
NOT legal rules or standards by nature BUT :
– Specificity of German Statutory Accident
Prevention Regulations: some, through apparently
technical rules, have a dual legal character; UVV or
BGV which are issued by insurers and professional
associations
Few details
22. CHINA
• China is a centralized political system,
• However, the principal regulations are not necessarily
be found at the national level (as in France, as opposed
to federal system such as the US),
• Other important regulations can be found at regional
and municipal level, NOT ONLY regarding
environmental questions BUT ALSO in the field of HS.
• This especially concerns industrially developed areas like
Beijing, Shanghai and Guangdong.
Few details
24. FRANCE
• A particularity of the French legal system is that
if you have an installation or site which is
classified as “ICPE” (installation classée pour
l’environnement), a special set of rules that
applies (e.g. Chapter V of the French
Environmental Code] .
