AQSIQ announcement No.55 : Administrative provision on recording
of importers and exporters of import foods
Good morning everyone, Ladies and Gentlemen,
I am Zhangfeng, come from Institute of Food Safety (IFS), Chinese Academy of Inspection and Quarantine (CAIQ). The topic of my presentation is ‘Outline of China’s Supervision System for Imported Food’.
First of all, I will make a brief introduction about CAIQ. CAIQ, as the exclusive state-level scientific research institution of AQSIQ, is located in Yizhuang Economic Development Zone, Daxing District, Southeast of Beijing.
There are about 30 staffs in the institute of food safety, including 3 professors, 8 associate professors, 6 post-doctors (3 of them having abroad study experiences) and 10 doctors. The research area is about 3200 m2. Total equipment costs about 95 million RMB including many kinds of large-scale instrument for the residue analysis such as Gas Chromatography mass spectrometry (GC/MS), high performance liquid Chromatography tandem mass spectrometry (HPLC/MS/MS), time of flight mass spectrometry (TOF), Orbitrap and so on.
Our institute, founded in 1978, is responsible for the risk monitoring of import and export food safety and the related scientific research. The laboratory is the Key laboratory of AQSIQ, reference laboratory of residue analysis and passed the accrditations from different organizatons such as ISO / IEC 17025, China Metrology Accreditation (CMA), approved the recognition of China National Accreditation Service for Conformity (CNAS), and achieved the first qualification certificate from National food inspection agency.
We also undertook many scientific projects on the food safety, involved in the detection of toxic and harmful substances in food, such as chemical, pathogenic bacteria, natural toxins, heavy metals and so on, mainly by various modern chromatography, mass spectrometry, spectroscopy, and immunological techniques to carry out the study of multi residue, multi-component, high-throughput, fast, on-site and ultra trace detection technology.
In 1995, China’s food hygiene act was implemented, which is mainly focused on catering and consumption. However, with the rapid development of China’s food industry, its scope has extended to agriculture, agricultural product processing, food manufacturing, food distribution, and the catering industry. The traditional concept of food hygiene, has become increasingly outdated and has been replaced by a universal notion “food safety.” After Sanlu powder milk scandal in 2008, the government of China accelerated legislation to encompass the whole life cycle of food from farm to table. In 2009, China promulgated food safety act.
Since Food safety law has given AQSIQ the responsibility to supervise the imported food safety, it is necessary to intorduce the supervison system for the imported food to all of you.
First, I want to introduce the administrative structure of regulating the safety of imported food in China. General Administration of Quality Supervision, Inspection and Quarantine (AQSIQ) and the CIQ Authorities in each province supervise jointly on the imported food.
The related laws and regulations include the International Regulations, Laws, Administrative laws and regulatons, and also some Department Rules. Now I will make introduction one by one.
International regulation include WTO/SPS agreement, WTO/TPT agreement, Bilateral agreement and Memorandum.
Laws of the People's Republic of China include that on the Food Safety, the Import and Export Commodity Inspection, the Entry and Exit Animal and Plant Quarantine,the Frontier Health and Quarantine respectively.
Administrative Regulations are the detailed explaination for the laws mentioned above.
Department rules are mainly about the special rules for the imported and exported food such as meat products, aquatic products, and the related regulations such as food labelling, food safety assessment and so on.
Based on the risk analysis, China has established the supervision and management system for the food to be imported in which is in accordance with international practice. The procedure consistes of three links as follows:
Market acess before entry (ACESS)
On-spot inspection (INSPECTION)
Post entry supervision (MONITOR)
Now I will show you the demands of inspection and quaratine taking aquatic products as an example. Firstly, the improtor should know about the related regulations for access such as Entry requirements for inspection and Quarantine of China and AQSIQ announcement( such as the Notice on Further Strengthening the work of inspection and Quarantine of imported aquatic products. Secondly, it is important for the importers to know about the registration rules and the related notices. List of registered enterprises registered overseas production enterprises will be announced on website. Thirdly, the importers should get the approval according to the entry requirements for products quarantine approval and the supervision and administration rules. Then, the certificate could be achieved if all the foreign official requests and the special warehouse requests have been satisfied.
Before entry, there are four steps to be carried out for the imported food supervision. 1) risk analysis, first it is necessary to take the risk analysis on the food to be imported in China. 2) Sanitary Registration of Enterprise. enterprises should register according to the different requirements for different products such as meat, aquatic or diary products. 3) License for Quarantine of Entry Animals and Plants Quarantine (high risk animal and plant derived food) 4) Exporter filling——import and export business record management (AQSIQ (2012) No. 55). Now I will make detailed explaination for these.
When the imported food arrived the port, the inspection and quarantine should be carried out according to the related regulations. Each year AQSIQ will develop imported food monitoring plans and issued alert to substandard food on the website. In addition, label verification is also needed.
Requirements for Enterprises Inspection are as follows:
1) Import goods declaration form
2) Trade Contract, Packing List, Bill of lading, Commercial Invoice, Health Certificate, Quantity Certificate
3) Certificate of Origin, Sanitation Evaluation
4) the License for Quarantine of Entry Animals and Plants Quarantine
5) Safety and hygiene certificate (original) of official institution in the country (region)
6) Imported pre packaged food - Import and export food labeling audit certificate (New Edition)
When the imported food entered into the domestic market, people are still concerned about their security. In order to trace back the problematic products, the importers should establish import and sales records (for more than two years). Besides this ,the credit record is also required and will be released on the website.
The records of import and sell should be established. The import information consists of the imported food name, brand, specifications, quantity, invoice value, production batch number, production date, shelf life, country of origin, the exporting country or region, manufacturer name and registered number in China, exporters or agents record number, import ports, destination, certificate number, inspection Number, entry time and so on.
The sell record consists of: where to be sold and the buyers’information, complaints of the consumers and the recall record.
