2. Current status of MSP
• The legal base for MSP in Poland - The act on Maritime areas
of Poland and Maritime Administration of March 21st, 1991
• Directive 2014/89/EU OF THE EUROPEAN PARLIAMENT AND OF
THE COUNCIL of 23 July 2014 establishing a framework for maritime
spatial planning -> implemented to the Polish law
• Amended Act on Maritime areas (…) is in force since 19th Nov 2015
• Ordinance of Minister of Transport, Building and Maritime
Economy and Minister of Regional Development on maritime
areas (of August 5, 2013) – determines required scope of maritime
spatial plans in the text and graphic part (the Ordinance is in the
process of consultation at the moment )

3. Who has mandate to plan?
The competent authorities on maritime spatial planning are
minister responsible for maritime affairs
(at present Minister of Maritime Economy and Inland Navigation)
and
director of maritime office
(according to territorial jurisdiction
Director of Maritime Office in Gdynia, Słupsk or Szczecin)
 Director of Maritime Office is responsible for developing the draft plan.
 The draft plan is the subject of an environmental impact assessment.
 The minister responsible for maritime affairs and the minister responsible for regional
development in consultation with the ministers in charge of environment, water
management, culture and national heritage, agriculture, fisheries, transport, internal
affairs and the Minister of National Defence shall adopt by ministerial order
maritime spatial plans for polish maritime areas.
 The maritime spatial plans are of binding character in Poland.

5. Timetable of MSP process
 No maritime spatial plan has been officially adopted in Poland yet
(up to now MSP procedure was tested only in EU projects e.g. pilot
project plan for the Middle Bank, Gulf of Gdansk and pilot plan of
Pomeranian Bay).

7. Latest news about MSP in Poland
 We have the funds to take an action!
 Funds for implementation of MSP draft for territorial sea, exclusive
economic zone and internal sea waters of Gulf of Gdansk in the
scale 1: 200 000 are already secured.
 Final work is underway on the tender documents and the draft
contract with the future contractor.
 Tender for the contractor is to be announced in February 2016.
