Intellectual Property Rights: its Meaning & Applications
 Intellectual Property Rights is the name given to legal
rights which protect creative works, Inventions &
Commercial goodwill. Basically Intellectual Property
Rights are designed to provide remedies against those
who steal & fruits of another person’s ideas or works.
 For example- If a person writes a computer program,
he will be able to take legal action to obtain an injection
against anyone who copies the program without his
permission.
 In case of the large investment require to finance
research, design & development in respect of computer
hardware & software, Intellectual Property Rights are of
crucial important as without such protection there would
be little incentive to invest in the development of new
products.
 Meaning of Intellectual Property: - Intellectual
Property is a property that arises from the human
intellect. It is a product of human creation, intellectual
process and is therefore the product of the human
intellect or mind.
 Basic content of Intellectual Property:-
 It is an intangible form of property.
 It is a personal property.
 It is a basic form of property.
 It is based on information.
 The objects of the rights covered by the
concept of intellectual property are
manifestations of human creativity.
 The form of the work
 The invention
 The relationship between a symbol and a
business.
 Intellectual Property Comprised two distinct
forms:-
 Literacy & Artistic Works
 Industrial Property
 Literacy & Artistic Works:- They are books,
Paintings, Musical Compositions, Plays, Movies,
Radio/TV Programs, Performance & other Artistic
works. They are protected by Copyright.
 Industrial Property:- Industrial Property describes
Physical Matter that is the product of an idea or
concepts for commercial purposes. They are
protected by Patented Objects, Trademarks,
 Patents: - A patent is an exclusive right granted for an
invention, which is a product or a process that provides a
new way of doing something, or offers a new technical
solution to a problem.
 Copyrights:- Copyright is a legal term describing rights given
to creators for their literacy & Artistic works. The Statutory
privilege extended to creators of works that are fixed in a
tangible medium of expression.
 Trademarks:- A name of an enterprise or a Mark capable of
being represented graphically, distinguishing the goods or
services of one person from those of others.
 Industrial Design Rights:- ‘Design’ means only the features of
shape, configuration, pattern, ornament or composition of
lines or colors applied to any article whether in two
dimensional or three dimensional or in both forms, by any
industrial process or means, whether manual, mechanical or
chemical, separate or combined, which in the finished article
 Intellectual Property Law in India:- There are many
big & small Intellectual Property law firms worldwide,
like in India, USA, UK, Chicago etc, providing qualitative
help to inventors & creators of product.
 In India Intellectual Property Rights are safely protected
& controlled by well-established statutory & judicial
frameworks. Apart from that, there are many attorneys
& law firms of intellectual property in Indian in various
states.

 About WIPO:-WIPO (World Intellectual Property
Organization) was established by the WIPO
Convention in 1967. This is a specialized agency of
the United Nations. It Promote the protection of
Intellectual Property throughout the world. Its
headquarters are in Geneva, Switzerland.
 Finally and gradually the various amendments has
been taken place to protect the original work of authors,
creators. To protect the IPR various organizations and
law came to existence such as World Intellectual
Property Organization (WIPO), Intellectual Property (IP)
Law.
 IPRs maintain this balance by putting in place time-
limits on the creators/owners mean of controlling a
particular work. The law that regulates the creation, use
and control of the protected work is popularly known as
Intellectual Property (IP) Law.
