There is no water quality standard or guidance value applicable to the receiving waters so we cannot recommend a water quality based effluent limit. Considering the above, I can't recommend any effluent limit at present.

In response to the new information that 1,4-dioxane is present in leachate, the previous effluent
limitations and monitoring requirements for the proposed remediation discharge have been
updated to require quarterly monitoring for this chemical. Our industrial permit writing guidance
does not have a recommended treatment level for this chemical so we have no default limit. It
appears that this chemical can be difficult to remove. There is no water quality standard or
guidance value applicable to the receiving waters so we cannot recommend a water quality based
effluent limit. Considering the above, I can't recommend any effluent limit at present. Note that
the existing WET testing requirements will help to address aquatic toxicity that could be caused
by the discharge of this chemical.
The attached requirements replace the ones previously sent. It is noted that no discharge
occurred under the previous set of requirements and that no treatment system yet exists. Existing
wastewaters are being hauled off-site for disposal.
The DOW does not have any regulatory authority over a discharge from a State, PRP, or Federal
Superfund Site. DER will be responsible for ensuring compliance with the attached effluent
limitations and monitoring requirements, and approval of all engineering submissions.
Condition 1 identifies the appropriate DER Section Chief as the place to send all effluent results,
engineering submissions, and modification requests. The Regional Water Engineer should be
kept appraised of the status of this discharge and, in accordance with the attached criteria,
receive a copy of the effluent results for informational purposes.
