Legal and Ethical Implications for Classroom Management When in the public schools
system there are many right and responsibilities that each person must play there part in as the
role of students, teacher, and parents. When reading and review several articles I came across
several issues that pertain and explain those rights and responsibilities. In the article that’s titled
Rights and Responsibilities of a Teacher and a Student written by Sarah Ganly,
it address many of the issues that are related to the responsibilities of the teacher in the classroom
and many of the rights that students have as well. While some don’t realize that one of the main
responsibilities of the teacher is to provide a safe learning environment for the students and take
care of them. Then the article explain the responsibilities of the parents on how to take their
children to a safe school in which they feel as though they are in a safe learning environment. In
the article, the author talks about the teacher’s liability and what they are held accountable for.
Take this for example, Teachers must report any abuse or anything in the relate fieldiftheythinkit
ishapping.Thisisthelawthat’sgivenfromthestate.Thisisallincompliance with the child’s welfare and
state of being. Granly, 2007). Not all the time this is always clear to be seen. This would be left
solely up to the classroom teacher as to what to look for. This would be a case by case of the
students that are in the teacher’s classroom and not only that but for the students in her
classroom. The teacher may even have to plan for a home visit announced or unannounced in
most cases. The teacher has a whole lot of responsibilities that he/she must take in account for
while being a teacher. Teachers must find a way to connect with their student to help them
experience real life experiences. in this article it also goes into detail about the inappropriate
behavior and what is appropriate for students and teachers. What the issue is what and how far
should the teacher and student relationship go. Granly states in the

article that the relationship should be a professional relationship and this is the main goal and
responsibility of the educator. Sometimes one can forget or fail to recognize that relationship.
A prime example of this would be, a teacher has the responsibility to watch and oversee the
student while going on a trip to the beach. It’s the student’s right to and the teacher right to
insure the safety and well-being of the child. It’s the parent’s job to insure that the child has the
necessary tools and things he/she need to go on the field trip to the beach. Another article I
reviewed was Public School Law- Teachers and Student’s Rights by Martha McCarthy. In this
article it explains the legal rights of students and the classroom teacher. It also discusses issues of
liabilities of the classroom teacher. The Negligent Tort Law is being discussed in this article as
well. It states that a teacher may be held accountable for a problem that may be able to have been
caused if the teacher had been monitoring the child in the proper way and reporting the problems
as they arise. (McCarthy & Cambron-McCabe, 1992).This article states that the law is clearly
noted that the job is to protect, which is a great responsibility for the teacher. That means taking
all cautions before anything happens to insure the student has proper care and supervised
properly at all time when a the home. This article also states that it is not the teacher
responsibility if the student causes harm or injury to himself because of poor choices they made.
The responsibility would not be on the teacher any more. The parents would have some part in
the liability if the child or children are not up to the proper age. There are many factors that are
involved when one may be held liable for when claiming a case of negligence with a student.
The last article that I found was named Response and Responsibility in the Classroom.
This article is about the duties and responsibilities of students in the classroom. The writer of this
article is tells ways of response that how a student would react to an educators classroom
management plan. This article was written by Edgar Baguio. The article states that the

student job in the classroom would be to follow all the rules and classroom procedures. The
article states that a really good an effective classroom takes both the student and the educator
who follows through with rules and regulations. Baguio believes that when both parties ³do
their responsibilities, it is easier to rely and trust each other (Baguio, 2008).´ Therefore, when
trust is established classroom management becomes less of an issue. There are a lot of issues that
deal with legal and ethical implications about classroom management for educators in the
classroom. I totally feel that after my method I choose for classroom management plan is very
appropriate for my classroom. After reviewing the Win-Win approach, I truly feel as though this
method will work out best in my classroom. I feel that this theory by Kagan, Kyle, and Scott
goes right along with my personal beliefs. I feel a great responsibility of teachers is to learn how
to properly teach the students to monitor their behavior themselves and make the students liable
for their own actions. This will help them to be able to manage their own behavior. The students
would be fulfilling their responsibilities and making wiser decisions about the behavior that they
display in the classroom. I feel as though my approach will help give students the skills to
succeed and be successful and taking ownership of their own behavior.

Legal and Ethical Implications 2 Legal and Ethical Implications for Classroom Management When in the public schools system there are many right and responsibilities that each person must play there part in as the role of students, teacher, and parents. When reading and review several articles I came across several issues that pertain and explain those rights and responsibilities. In the article that’s titled Rights and Responsibilities of a Teacher and a Student written by Sarah Ganly, it address many of the issues that are related to the responsibilities of the teacher in the classroom and many of the rights that students have as well. While some don’t realize that one of the main responsibilities of the teacher is to provide a safe learning environment for the students and take care of them. Then the article explain the responsibilities of the parents on how to take their children to a safe school in which they feel as though they are in a safe learning environment. In the article, the author talks about the teacher’s liability and what they are held accountable for. Take this for example, Teachers must report any abuse or anything in the relate fieldiftheythinkit ishapping.Thisisthelawthat’sgivenfromthestate.Thisisallincompliance with the child’s welfare and state of being. Granly, 2007). Not all the time this is always clear to be seen. This would be left solely up to the classroom teacher as to what to look for. This would be a case by case of the students that are in the teacher’s classroom and not only that but for the students in her classroom. The teacher may even have to plan for a home visit announced or unannounced in most cases. The teacher has a whole lot of responsibilities that he/she must take in account for while being a teacher. Teachers must find a way to connect with their student to help them experience real life experiences. in this article it also goes into detail about the inappropriate behavior and what is appropriate for students and teachers. What the issue is what and how far should the teacher and student relationship go. Granly states in the
  • 3. Legal and Ethical Implications 3 article that the relationship should be a professional relationship and this is the main goal and responsibility of the educator. Sometimes one can forget or fail to recognize that relationship. A prime example of this would be, a teacher has the responsibility to watch and oversee the student while going on a trip to the beach. It’s the student’s right to and the teacher right to insure the safety and well-being of the child. It’s the parent’s job to insure that the child has the necessary tools and things he/she need to go on the field trip to the beach. Another article I reviewed was Public School Law- Teachers and Student’s Rights by Martha McCarthy. In this article it explains the legal rights of students and the classroom teacher. It also discusses issues of liabilities of the classroom teacher. The Negligent Tort Law is being discussed in this article as well. It states that a teacher may be held accountable for a problem that may be able to have been caused if the teacher had been monitoring the child in the proper way and reporting the problems as they arise. (McCarthy & Cambron-McCabe, 1992).This article states that the law is clearly noted that the job is to protect, which is a great responsibility for the teacher. That means taking all cautions before anything happens to insure the student has proper care and supervised properly at all time when a the home. This article also states that it is not the teacher responsibility if the student causes harm or injury to himself because of poor choices they made. The responsibility would not be on the teacher any more. The parents would have some part in the liability if the child or children are not up to the proper age. There are many factors that are involved when one may be held liable for when claiming a case of negligence with a student. The last article that I found was named Response and Responsibility in the Classroom. This article is about the duties and responsibilities of students in the classroom. The writer of this article is tells ways of response that how a student would react to an educators classroom management plan. This article was written by Edgar Baguio. The article states that the

The article states that a really good an effective classroom takes both the student and the educator who follows through with rules and regulations. Baguio believes that when both parties ³do their responsibilities, it is easier to rely and trust each other (Baguio, 2008).´ Therefore, when trust is established classroom management becomes less of an issue. There are a lot of issues that deal with legal and ethical implications about classroom management for educators in the classroom. I totally feel that after my method I choose for classroom management plan is very appropriate for my classroom. After reviewing the Win-Win approach, I truly feel as though this method will work out best in my classroom. I feel that this theory by Kagan, Kyle, and Scott goes right along with my personal beliefs. I feel a great responsibility of teachers is to learn how to properly teach the students to monitor their behavior themselves and make the students liable for their own actions. This will help them to be able to manage their own behavior. The students would be fulfilling their responsibilities and making wiser decisions about the behavior that they display in the classroom. I feel as though my approach will help give students the skills to succeed and be successful and taking ownership of their own behavior.
