Maui County Governance - Transparency, Honesty, Integrity

Dear Don,
The words transparency, integrity and honesty are included by candidates to
express their qualifcations for ofce. These words become sources of complaint by the
electorate after the election and diminish the efectiveness and efciency of the elected
public ofcial. The suggestion that follows is presented for your consideration.
Of late the citizenry have become disenchanted with executive and legislative
branches of Maui County government. Both the Mayor and Council Members are
assailed as being dishonest, corrupt, liars and acting with disregard of the Public Trust.
The creation of an Ofce of the Ombudsman will restore balance and
transparency. The major diference between the State Ombudsman and the Maui
County Ombudsman is the extent of jurisdiction. The State Ombudsman has no
jurisdiction over the Ofce of the Mayor and the County Council. As proposed the
Maui County Ombudsman will have jurisdiction. The Maui County Ombudsman will
augment and strengthen the purview and authority of the Maui County Ethics
Commission.
Organizationally the Ofce of the Maui County Ombudsman will bring balance to
Maui County government.

2. CREATION OF THE MAUI COUNTY OFFICE OF THE OMBUDSMAN
The Ofce of The Maui County Ombudsman
1. The Ombudsman shall be appointed by the Mayor and by the County Council.
The Ombudsman shall serve at the pleasure of the Mayor and the County
Council and may be removed at any time by either the Mayor or the County
Council, acting independently or upon mutual consensus. The Ombudsman shall
be an at-will employee of the County of Maui. The Ombudsman may be
removed by cause, violation of the County Charter and/or violation of County
Ordinances.
2. The Ofce of The Ombudsman shall be autonomous reporting directly to the
Mayor and the County Council meeting in joint session.
3. All joint sessions shall be open to the public. Executive Sessions shall be
restricted to deliberations and decision making. Public testimony shall be
scheduled by the Ombudsman as necessary based upon the agenda of the
scheduled session or by request of any member of the public.
4. The investigatory authority of the Ofce of the Ombudsman shall be
unrestricted. All Departments, Department heads, managers, staf and
employees including the Ofce of the Mayor and County Council shall be subject
to the jurisdiction of the Ombudsman and representatives designated by the
Ombudsman.
5. Where the complaint or subject matter of the complaint requires the
involvement and participation of the State of Hawaii Ofce of the Ombudsman,
the Maui County Ombudsman shall consult with the State Ombudsman to
determine the extent of participation of each ofce.
6. The Ombudsman shall be the investigative and enforcement organization for the
Maui County Ethics Commission.
7. The decision of the Ombudsman whether a complaint is docketed and processed
for investigation is fnal and non-appealable.
3. 8. All complaints received shall be fled, logged and processed on a frst in, frst out
basis. Complaints shall be processed within 15 business days from receipt
unless additional time is required. Exceptions to the 15 business day processing
time shall noted on each case fle. Reasons and rationale shall be noted and
shall be presented at the beginning of each joint session.
9. Third party requests for information shall be processed pursuant to Chapter 92F,
Hawaii Revised Statutes Uniform Information Practices Act (UIPA).
10.For administrative purposes this ofce shall be attached to the Ofce of The
Corporation Counsel. The Ombudsman need not be an attorney. The
Ombudsman shall consult with the Corporation Counsel on matters requiring
legal advice or a legal opinion.
11. The Ofce of the Ombudsman budget shall be part of the Maui County Budget.
