Car manufacturers will face a moral and algorithmic
dilemma (equation of death):
• How should the car be programmed to act in the event of
an unavoidable accident ?
• Has it to minimize the loss of life, even though this means
sacrificing the life of the passengers,
or has it to protect the passengers
at all costs ?

• The Vienna Convention on Road Traffic
established the presence of a human driver who
must be able to follow the car’s functions and to
regain control at any time…
China is not a party to the Convention!
• The Convention was amended and since 23 June
2016, the automated driving systems are allowed
with respect to these two requirements:

1. The systems can be easily controlled by or
deactivated by the driver OR
2. They follow the regulationsof the United Nations
(Regulation No. 79 related to automatic steering
functions to driving conditions below 10km/h);
new UN regulations are expected in 2017.
China adopted its own regulations: Chongqing 2000
km test in Beijing of two cars by Changan
manufacturer in April 2016.

• Switzerland is a party to the Vienna Convention.
• On the 24th of April 2015 it allowed the testing of
an autonomous car on a small track…
• A study is being carried out in order to know
which regulations need to be amended so that
autonomous cars are allowed on Swiss roads.
• Switzerland is testing autonomous public
transportation as well.

• By Swiss law, the person responsible for a vehicle
accident is the owner.
• The owner is the person who has effectively and
lastingly the ability and the right to use the
vehicle and who uses it or makes it being used at
their expenses and in their interests.
• Provided some changes are made to this
regulation, it could easily be applied to
autonomous vehicles.

• Privacy regulations regarding personal data that
are collected thank to connected services when
using the autonomous vehicle
• Selection of a liability system that allocate risks
between the different players (manufacturers,
drivers, developer of the autonomous system...)

• As usual, regulations will lag behind the
technologies.
• Now the regulations must be amended to allow
the deployment of autonomous cars globally.
• The regulatory restrictions will be taken care of
later and according to each national law.

• The global economic issue is massive, and a
regulation based on the Vienna Convention would
be an adequate response.
• However, there is a concern that each country –
and especially those that host manufacturer’s
headquarters – will take some steps in order to
safeguard their economy and benefits. That
would compromise the standardisation of the
legal apprehension of the problems.
