Abstract: In the village of Adjamé-Bingerville, the land issue is put to the test by galloping rurbanisation. It
gives rise to land disputes within the Ebrié indigenous community, inevitably leading to social changes in land
governance. Based on field surveys, this study aims to understand how rurbanization leads to land conflicts and
social changes in the social space of Adjamé-Bingerville. Data analysis was carried out using the thematic
content analysis method, supported by documentary research, direct observation and semi-structured interviews.
The results obtained show that in a context of rurbanisation, intra-family and inter-group land conflicts
(Ministry of Construction and heads of families) contribute to the recomposition and redistribution of the roles
and statuses of the different social categories. They allow the positioning of young people and the ministry of
construction in the land arena dominated by the elders. Land conflicts then become a marker of differentiation
allowing the adaptation of land tenure by the emergence of individual land heritage alongside family land
heritage.

Factors affecting undergraduate students’ motivation at a university in Tra VinhAJHSSR Journal
ABSTRACT: Motivation plays an important role in foreign language learning process. This study aimed to
investigate student’s motivation patterns towards English language learning at a University in Tra Vinh, and factors
affecting their motivation change toward English language learning of non-English-major students in the semester.
The researcher used semi-structured interview at the first phase of choosing the participants and writing reflection
through the instrument called “My English Learning Motivation History” adapted from Sawyer (2007) to collect
qualitative data within 15 weeks. The participants consisted of nine first year non-English-major students who learning
General English at pre-intermediate level. They were chosen and divided into three groups of three members each
(high motivation group; average motivation group; and low motivation group). The results of the present study
identified six visual motivation patterns of three groups of students with different motivation fluctuation, through the
use of cluster analysis. The study also indicated a diversity of factors affecting students’ motivation involving internal
factors as influencing factors (cognitive, psychology, and emotion) and external factors as social factors (instructor,
peers, family, and learning environment) during English language learning in a period of 15 weeks. The findings of
the study helped teacher understand relationship of motivation change and its influential factors. Furthermore, the
findings also inspired next research about motivation development in learning English process.

ABSTRACT :This research aims to analyze the correlation between employee work stress and digital literacy
with employee performance at PT Telkom Akses Area Cirebon, both concurrently and partially. Employing a
quantitative approach, the study's objectives are descriptive and causal, adopting a positivist paradigm with a
deductive approach to theory development and a survey research strategy. Findings reveal that work stress
negatively and significantly impacts employee performance, while digital literacy positively and significantly
affects it. Simultaneously, work stress and digital literacy have a positive and significant influence on employee
performance. It is anticipated that company management will devise workload management strategies to
alleviate work stress and assess the implementation of more efficient digital technology to enhance employee
performance.

The Settlement of Construction Disputes Through Dispute Councils From the Per...AJHSSR Journal
ABSTRACT:This research differs from the practice of business activity in the construction services industry,
which may lead to construction disputes. The settlement of construction disputes is a consensus based on the
basic principle of debate. If the discussions between the parties do not reach an agreement, the parties may take
measures to resolve the dispute through the dispute council. Because the standard governing the disputes
committee was not fully regulated, they did not comply with the principle of legal certainty. Therefore, further
research was needed to establish a theoretical basis for regulating the disputes committee in settling construction
disputes. This research is a standard legal research using a legal regulatory, conceptual, and comparative
approach. The research results show that the ideal concept of resolving construction disputes through a dispute
council based on the value of legal certainty is to establish that the position of the dispute council is a special
court that has the authority to resolve construction disputes under construction services agreements. To realize
the position of the Court of Disputation as a special court, it must be based on the creation of philosophical
values, the creationof legislative regulations, and the creation of the institutional structure of the Court of
Disputation.

ABSTRACT : Oral literature is a creative work of art that portends high merit and has the creative use of
imagination in preliterate societies. It adopts the genres of literature: drama, prose and poetry in the oral milieu,
using performance as its hallmark. It thrives on the use of oral data because of its orality. This paper focuses on
the moral values or oral literature in the society using Ogba as a spring board. The study was carried out in
communities ofOgba. The population of the study consists of ten towns and village, in Ogba. The theoretical
framework used is Dell Hyme’s ethno-poetics because the works of oral literature relate to the society. This
paper concludes that oral literature serves to against all odds; communicate ideas, emotions, beliefs and
appreciation of life. The folktales in Ogba for instance, serve similar purpose through their
rendition/performance. Through the stories, the younger generation in Ogba society is familiarised with the
customs, traditions, and rituals prevalent in the society. This paper therefore recommends the use of oral
literature in all its genres to inculcate moral values and lessons to the teenagers and youths. Against this
background, Ogba (African) themselves must cease to regard oral literature as primitive and fetish.

kumbersasyonal na wika at makabagong istilo sa pagsulat ng tula. Gamit ang mean at standard deviation,
lumabas na “Mataas” ang antas ng pagtanggap sa kabuuan ng mga gurong eksperto na tumaya sa nabuong
pagsusuri. Lumabas din na “Mataas” ang antas ng kanilang pagtanggap sa nabuong pagsusuri batay sa mga

University of Mindanao, Matina-main campus. Eight major themes emerged, including difficulties with language
proficiency, online learning, classroom interaction, examination systems, grading procedures, school regulations,
resource accessibility, coping mechanisms, and future goals. Implications include the requirement for targeted
language proficiency and technology use support, an understanding of adaption processes, interventions to
improve resource accessibility, and equitable public administration policies. The study underlines the importance
of adaptation in various educational contexts, as well as the role of educators and legislators in creating inclusive
learning environments.

The effect of Institutional Ownership, Sales Growth and Profitability on Tax ...AJHSSR Journal
ABSTRACT: This research aims to test, analyze and obtain empirical evidence about the influence of
institutional ownership, sales growth and profitability on tax avoidance. The object of this research is
manufacturing companies in the consumer goods industry sector listed on the Indonesia Stock Exchange (BEI)
in 2018-2022. This research used quantitative research methods and causal research design. The sampling
technique in this research used non-probability sampling with purposive sampling as the basis for determining
the sample so that a sample of 55 samples was obtained. The data used is secondary data obtained from the
official website of the Indonesia Stock Exchange (BEI) during the 2018-2022 period. The data analysis method
used was multiple linear regression analysis with several tests such as descriptive statistical tests, classical
assumption tests, and hypothesis testing using SPSS version 26 statistical software. The results showed that the
institutional ownership variable has no effect on tax avoidance, while the sales growth and profitability has a
negative and significant effect on tax avoidance.

pangkatang talakayan at paggawa ng mga koneksyon sa tunay na karanasan sa buhay bilang mga estratehiya sa
pagtuturo ng panitikan sa Filipino at pasalitang partisipasyon ng mga mag-aaral sa Baitang 7 ng Misamis
University Junior High School, Ozamiz City. Ang ginamit na disenyo sa pananaliksik na ito ay deskriptivcorrelational. Ang mga datos sa pag-aaral ay nagmula sa kabuuang populasyon na 120 na mag-aaral at tatlong
mga guro na tagamasid sa pasalitang partisipasyon ng mga mag-aaral. Ang Talatanungan sa Kagamitan sa
Pagtuturo ng Panitikan at Checklist batay sa Obserbasyon sa Pasalita na Partisipasyon ay ang instrumentong
ginamit sa pagkalap ng datos. Mean, standard deviation, Analysis of Variance at Pearson Product-Moment
Correlation Coefficient ang mga ginamit na estatistiko na sangkap. Inihayag sa naging resulta na ang tatlong piling
estratehiya sa pagtuturo ng panitikan sa Filipino ay may pinakamataas na antas ng kagustuhan ng mga mag-aaral.
Ang antas ng pakilahok ng mga mag-aaral sa paggamit ng tatlong estratehiya sa pagtuturo ng panitikan ay
pinakamataas na nagpapahiwatig na aktibong nakilahok ang mga mag-aaral sa mga gawain. Inihayag din na
walang makabuluhang kaibahan sa antas ng kagustuhan ng mga mag-aaral sa mga estratehiya sa pagtuturo ng
panitikan sa Filipino. Ito ay nangahulugan na gustong-gusto ng mga mag-aaral ang pagkakaroon ng mga
estratehiya sa pagtuturo. Walang makabuluhang kaugnayan ang kagustuhan sa mga estratehiya at antas ng
pakikilahok ng mga mag-aaral. Hindi nakaapekto sa kanilang pakikilahok ang anumang estratehiyang ginamit ng
guro.

ABSTRACT :Throughout my studies and teaching English in different language centers and higher studies
institutions, I have come to conclude that students consider Reading comprehension as a nightmare that
frightens them and hinders their language acquisition in the Moroccan EFL Context. This may cause them to
develop an internal psychological obstacle that grows as their lack of the necessary instruments or tools to
overcome are not equipped with. They become lost and unaware about or unfamiliar with the necessary reading
comprehension strategies that could help them to face the problem of misunderstanding or non-understanding
of English texts. Respectively, this article which is only one part of my whole study aims at showing the effect
of teaching reading strategies in enhancing the S1 students‟ familiarity with reading strategies and raising their
frequency use. A sample of 283 University students in EFL context have been chosen randomly and have

A Model of Disaster Resilience Among Colleges and Universities: A Mixed Metho...AJHSSR Journal
ABSTRACT :This research paper aimed to create a comprehensive framework for measuring disaster
resilience in colleges and universities. The study used a mixed method through Exploratory Factor Analysis
(EFA), which involved analyzing data from a survey questionnaire. The questionnaire was developed based on
in-depth interviews with 12 selected participants from the University of Mindanao, as well as relevant literature
and studies. It was reviewed and validated by 10 experts using a method called Content Validity Ratio (CVR).
This questionnaire was then administered to 400 students from 10 different colleges in University of Mindanao.
After conducting the Exploratory Factor Analysis and performing rotations and iterations, the researchers
identified five main constructs that characterize disaster resilience among colleges (1) disaster preparedness, (2)
disaster awareness, (3) community readiness, and (4) disaster management, (5) disaster resilience. The
researchers aimed to create an organization called “Council of College Disaster Volunteers (CCDV)” which
consist of student volunteers. These factors can be used to develop effective management strategies and
strengthen efforts in preventing and managing disasters and accidents.

Environmental Struggles and Justice Among Lumad Farmers of Davao CityAJHSSR Journal
ABSTRACT : The study described the various environmental struggles experienced among the participants
and their status in accessing justice. The study followed a qualitative multiple-case study approach; the
participants are the Lumad farmers of Marilog, Davao City selected through a Critical sampling method and
aims to present the environmental violations experienced by the Lumad farmers in Davao City and how it
affected their families and sustenance further, their status in accessing justice is also explored. The study
concluded that the most common struggles the participant experience are Illegal logging and improper waste
disposal, which affect their farms, family, health, and income. Their preferred means to accessing justice is
through barangay settlement; the rigors of accessing courts, such as distance, expenses, fear of ruling, and the
hassle of being called to be present in court, are the most prevalent barriers that hinder the lead farmers from
accessing justice or seeking legal action. Nevertheless, the participants believed that the government would help
them in accessing justice.

ABSTRACT:This paper explores the cyberbullying experiences among Criminology students at the
University of Mindanao. A simple random sampling method was used to distribute the study's online
questionnaire to the respondents and to survey the target population. This study has four hundred (400)
respondents, and the respondents are Criminology students at the University of Mindanao. The findings of this
study revealed that the level of cyberbullying experiences is sometimes manifested. On the other hand, the
cyberbullying experiences of the students indicate a moderate level, which indicates that the cyberbullying
experiences of the respondents are sometimes manifested. Also, the computations showed that among the
indicators presented, the highest mean is obtained in the psychological effect, which implies that there is a
significant effect of cyberbullying experiences of the respondents in terms of the Gender level of the
respondents. Therefore, respondents with a low level of cyberbullying experiences tend to have a moderate level
of cyberbullying experience. However, there is no significant effect in terms of age and year level of the
respondents according to the results regarding the psychological, emotional, and physical impact of
cyberbullying.

ABSTRACT: One of the most significant contributions of psychoanalysis to understand the human being is the
elaboration of a model about the mind from a topical and dynamic perspective. Freud explains the mind by the
constitution of the preconscious, conscious, and subconscious. Later, by three dynamic components: the id, the
ego and the superego. Such an organization of the psychic apparatus supposes not only individual elements, but
social influences along the process of hominization. In this paper, we recover the findings of the renowned
anthropologist Lewis Morgan, trying to link some of them to the psychoanalytic theory. Especially highlighting
the importance of superego in Haidt’s social intuitionism.

Improving Workplace Safety Performance in Malaysian SMEs: The Role of Safety ...AJHSSR Journal
ABSTRACT: In the Malaysian context, small and medium enterprises (SMEs) experience a significant
burden of workplace accidents. A consensus among scholars attributes a substantial portion of these incidents to
human factors, particularly unsafe behaviors. This study, conducted in Malaysia's northern region, specifically
targeted Safety and Health/Human Resource professionals within the manufacturing sector of SMEs. We
gathered a robust dataset comprising 107 responses through a meticulously designed self-administered
questionnaire. Employing advanced partial least squares-structural equation modeling (PLS-SEM) techniques
with SmartPLS 3.2.9, we rigorously analyzed the data to scrutinize the intricate relationship between safety
behavior and safety performance. The research findings unequivocally underscore the palpable and
consequential impact of safety behavior variables, namely safety compliance and safety participation, on
improving safety performance indicators such as accidents, injuries, and property damages. These results
strongly validate research hypotheses. Consequently, this study highlights the pivotal significance of cultivating
safety behavior among employees, particularly in resource-constrained SME settings, as an essential step toward
enhancing workplace safety performance.

ABSTRACT: The study explores Psychological Empowerment and Empathy as Correlates of Forgiveness.
The two variables are regarded to have influence on the decision one makes to forgive another. The study aimed
at examining the relationships between psychological empowerment and forgiveness, empathy and forgiveness
and to identify which one of the two,Psychological Empowerment or Empathy, is the more powerful predictor of
forgiveness. The study took a survey design with a sample of 350 drawn from a population of university students
using a self-administered questionnaire with four sections: Personal information, Psychological empowerment
scale, Toronto Empathy questionnaire, and the Heartland Forgiveness Scale (HFS). Data analysis employed
Pearson’s product moment correlation and regression analysis to test hypotheses. The results show significant
relationships between psychological empowerment and forgiveness as well as empathy and forgiveness.
Empathy was found to be the more powerful predictor of forgiveness.

research. The analysis is centered around the authors, countries, institutions, and keywords of the articles. The
findings highlight prominent researchers in this field, leading universities, and influential journals. Particularly,
it is identified that China plays a leading role in "felt obligation" research. The analysis of keywords emphasizes
the thematic focuses of these studies and provides a roadmap for future research. Finally, various
recommendations are presented to deepen the knowledge in this area and promote applied research. This study
serves as a foundation to expand and advance the understanding of "felt obligation" in the field.

Factors affecting undergraduate students’ motivation at a university in Tra VinhAJHSSR Journal
ABSTRACT: Motivation plays an important role in foreign language learning process. This study aimed to
investigate student’s motivation patterns towards English language learning at a University in Tra Vinh, and factors
affecting their motivation change toward English language learning of non-English-major students in the semester.
The researcher used semi-structured interview at the first phase of choosing the participants and writing reflection
through the instrument called “My English Learning Motivation History” adapted from Sawyer (2007) to collect
qualitative data within 15 weeks. The participants consisted of nine first year non-English-major students who learning
General English at pre-intermediate level. They were chosen and divided into three groups of three members each
(high motivation group; average motivation group; and low motivation group). The results of the present study
identified six visual motivation patterns of three groups of students with different motivation fluctuation, through the
use of cluster analysis. The study also indicated a diversity of factors affecting students’ motivation involving internal
factors as influencing factors (cognitive, psychology, and emotion) and external factors as social factors (instructor,
peers, family, and learning environment) during English language learning in a period of 15 weeks. The findings of
the study helped teacher understand relationship of motivation change and its influential factors. Furthermore, the
findings also inspired next research about motivation development in learning English process.

ABSTRACT :This research aims to analyze the correlation between employee work stress and digital literacy
with employee performance at PT Telkom Akses Area Cirebon, both concurrently and partially. Employing a
quantitative approach, the study's objectives are descriptive and causal, adopting a positivist paradigm with a
deductive approach to theory development and a survey research strategy. Findings reveal that work stress
negatively and significantly impacts employee performance, while digital literacy positively and significantly
affects it. Simultaneously, work stress and digital literacy have a positive and significant influence on employee
performance. It is anticipated that company management will devise workload management strategies to
alleviate work stress and assess the implementation of more efficient digital technology to enhance employee
performance.

The Settlement of Construction Disputes Through Dispute Councils From the Per...AJHSSR Journal
ABSTRACT:This research differs from the practice of business activity in the construction services industry,
which may lead to construction disputes. The settlement of construction disputes is a consensus based on the
basic principle of debate. If the discussions between the parties do not reach an agreement, the parties may take
measures to resolve the dispute through the dispute council. Because the standard governing the disputes
committee was not fully regulated, they did not comply with the principle of legal certainty. Therefore, further
research was needed to establish a theoretical basis for regulating the disputes committee in settling construction
disputes. This research is a standard legal research using a legal regulatory, conceptual, and comparative
approach. The research results show that the ideal concept of resolving construction disputes through a dispute
council based on the value of legal certainty is to establish that the position of the dispute council is a special
court that has the authority to resolve construction disputes under construction services agreements. To realize
the position of the Court of Disputation as a special court, it must be based on the creation of philosophical
values, the creationof legislative regulations, and the creation of the institutional structure of the Court of
Disputation.

ABSTRACT : Oral literature is a creative work of art that portends high merit and has the creative use of
imagination in preliterate societies. It adopts the genres of literature: drama, prose and poetry in the oral milieu,
using performance as its hallmark. It thrives on the use of oral data because of its orality. This paper focuses on
the moral values or oral literature in the society using Ogba as a spring board. The study was carried out in
communities ofOgba. The population of the study consists of ten towns and village, in Ogba. The theoretical
framework used is Dell Hyme’s ethno-poetics because the works of oral literature relate to the society. This
paper concludes that oral literature serves to against all odds; communicate ideas, emotions, beliefs and
appreciation of life. The folktales in Ogba for instance, serve similar purpose through their
rendition/performance. Through the stories, the younger generation in Ogba society is familiarised with the
customs, traditions, and rituals prevalent in the society. This paper therefore recommends the use of oral
literature in all its genres to inculcate moral values and lessons to the teenagers and youths. Against this
background, Ogba (African) themselves must cease to regard oral literature as primitive and fetish.

ABSTRACT: This qualitative study investigates the adaption experiences of indigenous college students at the
University of Mindanao, Matina-main campus. Eight major themes emerged, including difficulties with language
proficiency, online learning, classroom interaction, examination systems, grading procedures, school regulations,
resource accessibility, coping mechanisms, and future goals. Implications include the requirement for targeted
language proficiency and technology use support, an understanding of adaption processes, interventions to
improve resource accessibility, and equitable public administration policies. The study underlines the importance
of adaptation in various educational contexts, as well as the role of educators and legislators in creating inclusive
learning environments.

The effect of Institutional Ownership, Sales Growth and Profitability on Tax ...AJHSSR Journal
ABSTRACT: This research aims to test, analyze and obtain empirical evidence about the influence of
institutional ownership, sales growth and profitability on tax avoidance. The object of this research is
manufacturing companies in the consumer goods industry sector listed on the Indonesia Stock Exchange (BEI)
in 2018-2022. This research used quantitative research methods and causal research design. The sampling
technique in this research used non-probability sampling with purposive sampling as the basis for determining
the sample so that a sample of 55 samples was obtained. The data used is secondary data obtained from the
official website of the Indonesia Stock Exchange (BEI) during the 2018-2022 period. The data analysis method
used was multiple linear regression analysis with several tests such as descriptive statistical tests, classical
assumption tests, and hypothesis testing using SPSS version 26 statistical software. The results showed that the
institutional ownership variable has no effect on tax avoidance, while the sales growth and profitability has a
negative and significant effect on tax avoidance.

ginamit sa pagkalap ng datos. Mean, standard deviation, Analysis of Variance at Pearson Product-Moment
Correlation Coefficient ang mga ginamit na estatistiko na sangkap. Inihayag sa naging resulta na ang tatlong piling
estratehiya sa pagtuturo ng panitikan sa Filipino ay may pinakamataas na antas ng kagustuhan ng mga mag-aaral.
Ang antas ng pakilahok ng mga mag-aaral sa paggamit ng tatlong estratehiya sa pagtuturo ng panitikan ay
pinakamataas na nagpapahiwatig na aktibong nakilahok ang mga mag-aaral sa mga gawain. Inihayag din na
walang makabuluhang kaibahan sa antas ng kagustuhan ng mga mag-aaral sa mga estratehiya sa pagtuturo ng
panitikan sa Filipino. Ito ay nangahulugan na gustong-gusto ng mga mag-aaral ang pagkakaroon ng mga
estratehiya sa pagtuturo. Walang makabuluhang kaugnayan ang kagustuhan sa mga estratehiya at antas ng
pakikilahok ng mga mag-aaral. Hindi nakaapekto sa kanilang pakikilahok ang anumang estratehiyang ginamit ng
guro.

ABSTRACT :Throughout my studies and teaching English in different language centers and higher studies
institutions, I have come to conclude that students consider Reading comprehension as a nightmare that
frightens them and hinders their language acquisition in the Moroccan EFL Context. This may cause them to
develop an internal psychological obstacle that grows as their lack of the necessary instruments or tools to
overcome are not equipped with. They become lost and unaware about or unfamiliar with the necessary reading
comprehension strategies that could help them to face the problem of misunderstanding or non-understanding
of English texts. Respectively, this article which is only one part of my whole study aims at showing the effect
of teaching reading strategies in enhancing the S1 students‟ familiarity with reading strategies and raising their
frequency use. A sample of 283 University students in EFL context have been chosen randomly and have
attended the usual academic reading classes, yet only 76 are subject to this survey. 38 of them constitute the
experimental group who have attended the treatment regularly in one of the language centers and the other 38

Environmental Struggles and Justice Among Lumad Farmers of Davao CityAJHSSR Journal
ABSTRACT : The study described the various environmental struggles experienced among the participants
and their status in accessing justice. The study followed a qualitative multiple-case study approach; the
participants are the Lumad farmers of Marilog, Davao City selected through a Critical sampling method and
aims to present the environmental violations experienced by the Lumad farmers in Davao City and how it
affected their families and sustenance further, their status in accessing justice is also explored. The study
concluded that the most common struggles the participant experience are Illegal logging and improper waste
disposal, which affect their farms, family, health, and income. Their preferred means to accessing justice is
through barangay settlement; the rigors of accessing courts, such as distance, expenses, fear of ruling, and the
hassle of being called to be present in court, are the most prevalent barriers that hinder the lead farmers from
accessing justice or seeking legal action. Nevertheless, the participants believed that the government would help
them in accessing justice.

CYBERBULLYING EXPERIENCES OF UNIVERSITY OF MINDANAO CRIMINOLOGY STUDENTSAJHSSR Journal
ABSTRACT:This paper explores the cyberbullying experiences among Criminology students at the
University of Mindanao. A simple random sampling method was used to distribute the study's online
questionnaire to the respondents and to survey the target population. This study has four hundred (400)
respondents, and the respondents are Criminology students at the University of Mindanao. The findings of this
study revealed that the level of cyberbullying experiences is sometimes manifested. On the other hand, the
cyberbullying experiences of the students indicate a moderate level, which indicates that the cyberbullying
experiences of the respondents are sometimes manifested. Also, the computations showed that among the
indicators presented, the highest mean is obtained in the psychological effect, which implies that there is a
significant effect of cyberbullying experiences of the respondents in terms of the Gender level of the
respondents. Therefore, respondents with a low level of cyberbullying experiences tend to have a moderate level
of cyberbullying experience. However, there is no significant effect in terms of age and year level of the
respondents according to the results regarding the psychological, emotional, and physical impact of
cyberbullying.

ABSTRACT: One of the most significant contributions of psychoanalysis to understand the human being is the
elaboration of a model about the mind from a topical and dynamic perspective. Freud explains the mind by the
constitution of the preconscious, conscious, and subconscious. Later, by three dynamic components: the id, the
ego and the superego. Such an organization of the psychic apparatus supposes not only individual elements, but
social influences along the process of hominization. In this paper, we recover the findings of the renowned
anthropologist Lewis Morgan, trying to link some of them to the psychoanalytic theory. Especially highlighting
the importance of superego in Haidt’s social intuitionism.

Improving Workplace Safety Performance in Malaysian SMEs: The Role of Safety ...AJHSSR Journal
ABSTRACT: In the Malaysian context, small and medium enterprises (SMEs) experience a significant
burden of workplace accidents. A consensus among scholars attributes a substantial portion of these incidents to
human factors, particularly unsafe behaviors. This study, conducted in Malaysia's northern region, specifically
targeted Safety and Health/Human Resource professionals within the manufacturing sector of SMEs. We
gathered a robust dataset comprising 107 responses through a meticulously designed self-administered
questionnaire. Employing advanced partial least squares-structural equation modeling (PLS-SEM) techniques
with SmartPLS 3.2.9, we rigorously analyzed the data to scrutinize the intricate relationship between safety
behavior and safety performance. The research findings unequivocally underscore the palpable and
consequential impact of safety behavior variables, namely safety compliance and safety participation, on
improving safety performance indicators such as accidents, injuries, and property damages. These results
strongly validate research hypotheses. Consequently, this study highlights the pivotal significance of cultivating
safety behavior among employees, particularly in resource-constrained SME settings, as an essential step toward
enhancing workplace safety performance.

Psychological Empowerment and Empathy as Correlates of ForgivenessAJHSSR Journal
ABSTRACT: The study explores Psychological Empowerment and Empathy as Correlates of Forgiveness.
The two variables are regarded to have influence on the decision one makes to forgive another. The study aimed
at examining the relationships between psychological empowerment and forgiveness, empathy and forgiveness
and to identify which one of the two,Psychological Empowerment or Empathy, is the more powerful predictor of
forgiveness. The study took a survey design with a sample of 350 drawn from a population of university students
using a self-administered questionnaire with four sections: Personal information, Psychological empowerment
scale, Toronto Empathy questionnaire, and the Heartland Forgiveness Scale (HFS). Data analysis employed
Pearson’s product moment correlation and regression analysis to test hypotheses. The results show significant
relationships between psychological empowerment and forgiveness as well as empathy and forgiveness.
Empathy was found to be the more powerful predictor of forgiveness.

Exploring The Dimensions and Dynamics of Felt Obligation: A Bibliometric Anal...AJHSSR Journal
ABSTARCT: This study presents, to our knowledge, the first bibliometric analysis focusing on the concept of
"felt obligation," examining 120 articles published between 1986 and 2024. The aim of the study is to deepen our
understanding of the existing knowledge in the field of "felt obligation" and to provide guidance for further
research. The analysis is centered around the authors, countries, institutions, and keywords of the articles. The
findings highlight prominent researchers in this field, leading universities, and influential journals. Particularly,
it is identified that China plays a leading role in "felt obligation" research. The analysis of keywords emphasizes
the thematic focuses of these studies and provides a roadmap for future research. Finally, various
recommendations are presented to deepen the knowledge in this area and promote applied research. This study
serves as a foundation to expand and advance the understanding of "felt obligation" in the field.

village ébrié d’Adjamé-Bingerville (Côte d’Ivoire)

RESUME : Dans le village d’Adjamé-Bingerville, la question foncière est à l’épreuve de la rurbanisation
galopante. Elle donne lieu à des conflits fonciers au sein de la communauté autochtone Ebrié conduisant
inéluctablement à des mutations sociales au niveau de la gouvernance foncière. A partir des enquêtes de terrain,
la présente étude se propose de comprendre comment la rurbanisation entraîne les conflits fonciers et les
mutations sociales dans l’espace social d’Adjamé-Bingerville. L’analyse des données a été réalisée à partir de la
méthode d’analyse de contenu thématique, soutenue par la recherche documentaire, l’observation directe et les
entretiens semis directifs. Les résultats obtenus permettent de montrer que dans un contexte de rurbanisation, les
conflits fonciers intrafamiliaux et intergroupes (ministère de la construction et les chefs de familles) contribuent
à la recomposition et à la redistribution des rôles et statuts des différentes catégories sociales. Ils permettent le
positionnement des jeunes et le ministère de la construction dans l’arène foncière dominée par les aînés. Les
conflits fonciers deviennent alors un marqueur de différenciation permettant l’adaptation du régime foncier par
l’émergence du patrimoine foncier individuel au côté du patrimoine foncier familial.

Abstract: In the village of Adjamé-Bingerville, the land issue is put to the test by galloping rurbanisation. It
gives rise to land disputes within the Ebrié indigenous community, inevitably leading to social changes in land
governance. Based on field surveys, this study aims to understand how rurbanization leads to land conflicts and
social changes in the social space of Adjamé-Bingerville. Data analysis was carried out using the thematic
content analysis method, supported by documentary research, direct observation and semi-structured interviews.
The results obtained show that in a context of rurbanisation, intra-family and inter-group land conflicts
(Ministry of Construction and heads of families) contribute to the recomposition and redistribution of the roles
and statuses of the different social categories. They allow the positioning of young people and the ministry of
construction in the land arena dominated by the elders. Land conflicts then become a marker of differentiation
allowing the adaptation of land tenure by the emergence of individual land heritage alongside family land
heritage.

I. INTRODUCTION
Depuis la période précoloniale jusqu’à nos jours, la gestion des terres lignagères en Afrique ne repose
pas toujours sur des logiques économiques, mais très souvent sur des croyances, des valeurs sociales, des
symboles inhérents à la vie spirituelle, socioéconomique et politique. Ces croyances magico-religieuses sont
fondées sur des rapports entre la terre et les ancêtres. Dans cette perspective, les modes traditionnels d'accès à la
terre continuent d'avoir un impact majeur sur la structure de la propriété foncière et l'usage de la terre
(Biebuyck, 1963 et Kouamé, 2006). Le système coutumier accorde une prééminence à l’immuabilité et à la
sacralité de la terre (Boutillier et Dupire, 1960). Au Burkina Faso plus précisément à Diebougou, la gestion de la
ressource foncière est collective. Le régime foncier coutumier reposait sur la mise à disposition de la terre aux
différentes composantes de la société (groupes ethniques, clans, familles). L'accès aux terres dans le régime
foncier coutumier était soumis à l'appartenance à un groupe disposant d'un droit d'exploitation usufruitière. La
terre est considérée comme un bien commun inaliénable appartenant à toute la collectivité. Elle est souvent
caractérisée par sa conception sacrale, car le respect et la crainte liés à l'évocation du sacré, suffisent à maintenir
l'ordre dans son acquisition et sa gestion (Ouattara, 2006). En Côte d’Ivoire, dans toutes les sociétés rurales, la
gestion des ressources foncières est fondée sur le caractère inaliénable de la terre se transmettant de génération
en génération en conformité avec les règles de la tradition (Paulme, 1962). Ainsi, les règles et les normes

coutumières servent ainsi à maintenir et à transmettre le capital social. La terre familiale constitue l’unité
foncière ou chaque membre de la famille est le propriétaire de ce qu’il a acquis par son travail (Chauveau,
2000). Dans la société baoulé par exemple, la gestion foncière permettait la reproduction sociale du groupe en
assurant la consolidation, la solidarité et l'homogénéité du groupe (Babo, 2010.). Le chef tirait la légitimité et
l’autorité, de même que le prestige de cette fonction auprès des autres membres. En réalité, le contrôle de la
gestion du foncier par les vieux constitue un moyen d'exercice de leur domination sur les autres couches
sociales, notamment les jeunes et les femmes (Bado, 2010). Dans la société ébrié, les chefs de lignage sont les
principaux gestionnaires des terres et les seuls habilités à distribuer des parcelles aux autres membres de la
famille (Kouadio, 2015). Dans cette société, la terre est un bien collectif et inaliénable qui se transmet en lignée
utérine, c’est-à-dire que sa gestion passe de l’oncle (frère de la sœur), au neveu (fils de la sœur). Chaque village
riverain est propriétaire d’une portion, correspondant au prolongement des terres villageoises sur l’espace
aquatique dans la mesure où c’est un milieu approprié collectivement et un bien commun aux localités
environnantes (Kouadio, 2015). Dans cette logique, la structure foncière villageoise a une influence sur la
structure politique ébrié (Kouadio, 2015). Le pays ébrié en général et le village d’Adjamé-Bingerville en
particulier, connaissait jusqu’à une époque très récente, le développement de l’économie de plantation avec
l’existence de zone de plantations traditionnelles telles que le café, le cacao et d’autres cultures commerciales
industrielles tels le palmier à huile, la banane douce, ainsi que des cultures vivrières comme le manioc,
l’igname. La rupture d’avec ce type d’économie s’est opérée à une allure vive vers la fin des années 1980 dans
les villages ébrié. En effet, l’urbanisation a constitué un frein au développement de l’agriculture pérenne par
l’occupation des terres villageoises. Aujourd’hui, le peuple Ebrié d’Adjamé-Bingerville s’inscrit dans une
économie fortement dominée par l’économie marchande (la fabrication "d’attiéké") avec une croissance de la
population urbaine. Outre cela, le village bénéficie d’infrastructures routières, des écoles primaires, un centre de
santé, des magasins, des boutiques, un centre commercial, etc. De plus, pour faire entrer des devises dans les
caisses du village, le village s’est doté d’infrastructures routières, d’écoles primaires, d’un centre de santé, des
magasins, des boutiques, d’un centre commercial, etc. Les gestionnaires fonciers mettent en location des
magasins et des maisons à des particuliers ainsi que la vente de terrains qui constituent une source de revenu.
Cette pratique entraine des contestations dans la transmission des droits de propriété fonciers traditionnels par
les ayants droit en ligne agnatique. Pour régler les conflits, les gestionnaires font recours aux instances
villageoises pour appliquer les règles foncières en vigueur. En dépit des pratiques de patrimonialisation et de
préservation de la sacralisation de la terre, on assiste à la multiplication des conflits fonciers intrafamiliaux au
sein du village. Comment la rurbanisation contribue-t-elle à l’exacerbation des conflits fonciers et la mutation
sociale à Adjamé-Bingerville ? Ce qui a permis de dégager les unités d’analyses suivantes : i) rurbanisation
comme facteur structurant des conflits fonciers intrafamiliaux à Adjamé-Bingerville ; ii) influence de la
rurbanisation à Adjamé-Bingerville.

Le village d’Adjamé-Bingerville est située dans la sous-préfecture de Bingerville. Cette sous-préfecture
est située à six (6) km d’Abidjan. Le choix d’Adjamé-Bingerville s’explique non seulement par le nombre élevé
de conflits intrafamiliaux, mais également par la mutation du droit en matière d’accès à la terre à cause de la
rurbanisation galopante de la localité. Cette étude est la continuité de la précédente étude sur les enjeux de la
persistance des conflits intrafamiliaux dans la même localité (Koné, 2021). Celle-ci met un accent particulier sur
l’effet de la rurbanisation et les mutations engendrées dans cette communauté. Du point de vue méthodologique,
l’étude adopte une perspective qualitative et a mobilisé les outils et techniques de collecte des données. Il s’agit
de l’observation, des entretiens individuels semi-directifs et de focus group administrés auprès des chefs de
famille, des jeunes, de la chefferie villageoise (chef de village, notables), les membres de la commission
foncière, les institutions modernes (sous-préfet, ministère de la construction et de l’urbanisme). L’orientation
socio-anthropologique de cette étude et la contrainte liée au fait que nous ne disposions pas d’une base de
sondage, d’une liste exhaustive des individus composant la population ciblée, ont permis de mobiliser la
technique de l’échantillonnage de choix raisonné. A partir des entretiens retranscris, les données recueillies ont
fait l’objet d’une analyse dialectique. Cette méthode d’analyse des données a permis de saisir les contradictions
entre les discours traditionnalistes des aînés et modernes des jeunes et les responsables du ministère de la
construction. Au-delà de ces données d’analyse, le corpus d’informations recueillies a aussi contribué à dégager
des unités significatives permettant de mettre en évidence les différentes mutations sociales dans cet espace
social.
III. RESULTATS
3-1. Rurbanisation comme facteur structurant des conflits fonciers à Adjamé-Bingerville
3-1-1. Accaparement des espaces coutumiers familiaux par les institutions administratives
A Adjamé-Bingerville, la location et la mise en vente des terres sontdes pratiques qui foisonnent dans
cet espace social. Elle est la marque d’une rente foncière de la part des autorités coutumières du village. En
effet, le samedi 16 juillet 2016 survient un conflit qui oppose les détenteurs des droits fonciers familiaux et le
ministère de la construction et de l’urbanisme sur un espace de 400 ha. Les autochtones réclament la reprise de
leurs terres si le ministère de la construction ne paie pas leurs parcelles à leur juste valeur, c’est-à-dire à
10000f/m2 au moins au lieu des 2000 Francs CFA qui leur ont été remis. Le ressentiment envers l’Etat est
exprimé par H.K., chef de famille, appartenant à la génération Gnadôqui s’exprime en ses termes :
« L’Etat avec la complicité de notre chefferie achète nos terres à des
prix qui ne valent même pas la valeur de nos terres. Pourtant,
ailleurs, dans les autres villages, ils payent au meilleur prix. Quand
nous, on a appris ça bien évidemment qu’on n’était pas d’accord et
on a saisi l’Etat pour qu’il nous rende des comptes. Les responsables
nous ont dit que nos terres allaient servir pour des projets qui allaient
profiter à toute la communauté ». (H.K., chef de famille, appartenant
à la génération Gnadô, impliqué dans les conflits fonciers, ce 23
décembre 2020, Adjamé-Bingerville).
De ce qui précède, nous constatons que l’indemnisation compensatrice liée à la purge des droits
coutumiers n’est pas appréciée et acceptée par tous les acteurs villageois. En effet, la purge des droits
coutumiers est considérée comme un système d’accaparement, d’expropriation injustifiée de l’Etat. Elle
représente une injustice sociale par les populations rurales. Du côté du ministère de la construction, on estime
que l’aménagement foncier des 400 ha a été fait dans les règles de l’art avec le concours du chef du village,
cependant, celui-ci rejette tout aujourd’hui. Plusieurs rencontres ont eu lieu entre la communauté villageoise et
le sous-préfet de Bingerville pour tenter de trouver des solutions à ce conflit foncier et de faire baisser la tension
à Adjamé-Bingerville. On observe à l’issue de la marchandisation des terres familiales, une mise en valeur du
patrimoine foncier villageois. Comme acquéreurs des terres familiales mise en vente, on a plusieurs acteurs aux
nombres desquels l’Etat de Côte d’Ivoire représenté par le ministère de la construction et de l’urbanisme. Les
purges de droits coutumiers qui permettent à l’Etat d’avoir le contrôle de la ressource foncière à Adjamé-
Bingerville est contesté par les différentes familles qui sont les gestionnaires des terres mise en valeur. Ce
conflit foncier exprime les rapports conflictuels entre les autorités administratives et les autorités coutumières
dans la gestion foncière. L’Etat dans la mise en œuvre de projet d’aménagement à utilité publique exerce un
monopole sur les terres appartenant à des familles sans l’accord de ces différentes familles. Ces terres familiales,
dépossédées aux ayant droits coutumiers, sont revendues à des opérateurs privés. L’accaparement des terres
familiales par l’Etat de Côte d’Ivoire conduit la chefferie villageoise en accord avec les détenteurs des droits
fonciers familiaux à la mise en valeur rapide des terres familiales. L’aménagement des terres familiales par la
chefferie villageoise est dénommé le projet « Yamadan » dont l’objectif est la gestion durable du patrimoine
foncier et d’éviter la cession et l’expropriation des terres familiales par l’Etat. Il permet au village de se prendre

en charge à travers la réalisation d’infrastructures socioéconomiques. Toutefois, ce phénomène de rurbanisation
entraîne une désorganisation des instances coutumières.
3-1-2. Rurbanisation comme moyen de désorganisation des instances coutumières
La rurbanisation désigne un processus d’urbanisation progressive d’un territoire rural autour de noyaux
d’habitats traditionnels, caractérisé par l’installation de populations dont l’activité principale est la ville. Partant
de ce fait, la rurbanisation entraîne une modernisation, une inféodation des structures sociales traditionnelles par
le biais des infrastructures socio-économiques et de la scolarisation des populations rurales. Elle permet la
transposition, la juxtaposition des valeurs, des règles modernes au sein de la société traditionnelle. Les normes
de la rurbanisation deviennent des référents pour les jeunes ayant vécu en ville. C’est le cas de J. R., vice-
président de la jeunesse qui affirme ceci :
« C’est impossible pour nous d’avoir accès à l’héritage. Si on était en ville,
il n’y avait pas de problème, c’est pourquoi, moi, j’aime trop la ville, parce
que là-bas, il n’y a pas d’à peu près. Mais ici là, nous on ne représente rien
alors que là-bas, on voyait un avocat. On partait devant le juge et forcément
on allait avoir raison parce que la loi du tribunal, quand on parle de
succession et d’héritage, dit que ce sont les enfants de celui qui est mort qui
a droit à son héritage. Moi, je ne sais pas, c’est quel article de la loi qui dit
ça, mais c’est vrai et c’est ce que tout le monde sait depuis que cette loi
existe ». (J. R., vice-président de la jeunesse, ce 24 décembre 2020, Adjamé-
Bingerville).
Ces propos d’un jeune autochtone du village impliqué dans les conflits intrafamiliauxpermettent de
souligner que la catégorie sociale des cadets est confinée pour la plupart dans une économie de marché qui
véhicule les valeurs de la société moderne. Les caractéristiques sociodémographiques représentées par le niveau
d’instruction et le statut socioprofessionnel mettent en évidence la position adoptée par ces acteurs qui se
tournent vers une société qui leur permet de légitimer leurs actions visant la conquête et la prise de pouvoir au
sein de l’espace lignager. Exclu de la gestion de l’héritage, ces jeunes tentent une inversion de l’autorité des
aînés par la transformation des pratiques de gestion foncière. A l’analyse de ce discours, il est important pour
nous de mettre l’accent sur le fait que le jeune dispose d’une marge de manœuvre suffisante pour manipuler ou
négocier l’accès à la terre, sur la base de normes sociales variées et souvent contradictoires. Cette rurbanisation
des cadets constitue une marge de manœuvre qui leur permet de créer des zones de libertés par la contestation de
la gestion des aînés qu’ils jugent d’informelle. La rurbanisation est perçue par les aînés comme étant des
moyens dont mobilisent les cadets pour manipuler les règles de gestion foncière et créer le désordre au sein de
l’espace familial. En effet, pour les aînés, la rurbanisation des cadets avaitpour corollaire l’intellectualisation de
cette catégorie. Le système traditionnel de gestion foncière devient alors une institution obsolète et qui nécessite
un réaménagement voire une transformation complète. Cette rurbanisation de la part des cadets est le point focal
de toutes les revendications et contestation du système traditionnel de la part des cadets. Les propos deS.G.,
membre de la commission foncière viennent donner son point de vuesur le problème :
« Tous les problèmes qui arrivent en ce moment,sont liés l’héritage,
ilne faut pas chercher loin, c’est à cause du fait que pour la plupart,
ils sont quittés en ville et que là-bas, ils ont vu comment on accède à
l’héritage. C’est tout. Donc, ils veulent faire la même chose ici, mais
ici et là-bas, ce n’est pas la même chose, c’est différent. Nous nous
sommes au village et c’est la tradition qui prime sur tout. C’est
comme cela. Ils utilisent le fait qu’ils sont allés un peu à l’école pour
dire que ce sont des grands types, mais tout cela, c’est grâce à nous.
Parce que c’est nous qui avons permis qu’ils partent à l’école. Parce
que l’école, c’est bon. Maintenant, s’ils pensent que petit papier
qu’ils ont fait leur donne le pouvoir et droit à tout, ils mentent parce
que nous aussi on est allé à l’école, mais nous on ne fait pas comme

Cette posture représentative des aînés à l’égard de la position adoptée par les cadets montre que le fait
de s’urbaniser qui devrait être un moyen d’aide familiale devient une manière de se reconstruire et de
reconsidérer leurs rôles et attributs dans la gestion foncière. En effet, en s’insérant dans l’espace social dominé

par l’économie marchande, ces jeunes ont tendance à s’individualiser et à nier la primauté du droit coutumier
dans l’accès, le contrôle de la gestion de l’héritage familial. L’idéologie de la rurbanisation mobilisée par la
jeune génération pour contester la gestion de l’héritage par les ayants droits coutumiers participent à accroître
les tensions au sein des familles dans la mesure où chaque acteur se sent légitime dans cette gestion foncière.
Cependant, le droit coutumier est encré solidement dans les manières de penser et d’actions des aînés et des
institutions de gestion foncière. Les tentatives de changements de "l’ordre ancien"par la catégorie des cadets
sont influencées par la société moderne qui milite pour une marchandisation des rapports de production.
3-1-3. Rurbanisation comme expression de la marchandisation du foncier dans une société conservatrice
La marchandisation autour de la rente foncière est une pratique qui touche toutes les catégories sociales
(cadet et aîné) qui s’adonnent à cette pratique selon leurs sources de motivation. Pour les aînés dans la lutte pour
le contrôle de la terre qui les oppose aux cadets, la monétisation des terres familiales représente un moyen
d’assurer les dépenses du ménage (nourriture, vêtements, soins médicaux…) et la scolarisation de leur
progéniture. Quant aux cadets, cette pratique de marchandisation des terres familiales est une réponse aux
pratiques de conservation et à la manipulation de l’héritage de la part des aînés et des neveux en ligne utérine du
lignage. Elle représente pour eux le moyen de s’affirmer économiquement et de se défaire de la domination des
aînés. Partageant cette position, le témoignage de J H. jeune autochtone appartenant à la génération Tchaga
apporte des précisions sur cette question en ces termes :
« Ils vendent les terres, nous aussi, on va faire comme eux, parce que
c’est comme ça. On ne peut pas les regarder faire ça. Nous aussi, on
va vendre parce que c’est (la terre) pour nous aussi, on n’a pas le
choix. On vend parce qu’on a besoin d’argent pour s’occuper de
nous-même. Qui va nous donner à manger, on est obligé de faire des
petits trucs pour avoir quelque chose pour se défendre alors que nous
avons la terre. Il n’y a pas de bon travail ici et en ville là-bas, toi-
même (en parlant de nous) tu connais que pour trouver travail, c’est
dur si tu ne connais pas les gens bien placés. Donc, on revient chez
nous pour pouvoir avoir un peu pour se défendre. Mais quand tu
viens et que tu te rends compte que c’est dur aussi. Que les doyens
bloquent tout. Tu n’as pas le choix, tu trouves des solutions ou tu fais
comme eux. Œil pour œil, dent pour dent ». (J H. jeune autochtone

Dans cette perspective, la terre qui est souvent considérée comme un patrimoine non-aliénable devient
un bien d’autonomisation sociale, car elle est de plus en plus rare du fait de la croissance démographique. Avec
l’introduction de l’économie de marché dans les sociétés rurales, ce bien a acquis donc une valeur marchande
considérable. Partant de ce point de vue, les tenants de cette théorie préconisent un changement radical des
systèmes fonciers coutumiers qui, en règle générale, interdisent l’aliénation de la terre. Ces systèmes coutumiers
qui sont souvent basés sur les relations non-marchand ne peuvent donc plus répondre efficacement aux logiques
du marché, car ils sont accusés de ne pas motiver les individus à s’investir davantage dans la valorisation
économique de la terre. Dans le contexte actuel de la société ébrié d’Adjamé-Bingerville qui se « rurbanise » de
plus en plus, cette pratique est la marque de l’écart, de la rupture entre les discours visant la patrimonialisation
de la terre et les pratiques visant la vente et la mise en location du patrimoine foncier familial. Cet écart entre les
différentes pratiques et les discours représente une forte niche de la conflictualité au sein du lignage, car
favorisant la course à la propriété individuelle au détriment de la propriété collective prôné comme fondement
de cette société traditionaliste. Le témoignage de L.S. jeune autochtone appartenant à la génération Tchaga
donne sa position en ces termes :
« Ils n’ont qu’à abandonner leur histoire que la terre appartient à la
famille. Non, ce n’est pas le cas, elle appartient à un groupe
d’individus. Si c’est comme ça, chacun va venir prendre pour lui et se
servir parce que ce n’est pas pour un seul groupe. Chacun vient de
façon individuelle. Ils n’ont qu’à diviser la terre pour que tout le
monde puisse se servir. On dit que la terre est un bien familial, je suis
sûr que tu as entendu ça aussi, mais c’est faux, c’est pour une seule
personne qui prend tout pour lui seul. Quand c’est comme ça, nous
tous, on va faire la même chose » (L.S. jeune autochtone appartenant

Cette pratique ouvre la voie à la gestion individualisée du patrimoine foncier familial qui va à
l’encontre des droits et mode de gestion traditionnelle de la terre, et qui est représenté par l’immuabilité et la
gestion collective de la terre. Les représentations associées à la valorisation économique du patrimoine foncier
familial participent à la recrudescence des tensions à l’intérieur du champ familial. Les conflits fonciers dans cet
espace social mettent en évidence l’influence de l’Etat dans la gestion foncière qui se matérialise par
l’expropriation des terres familiales. Toutefois, la rurbanisation entraîne la migration de plusieurs populations
vers le village. Cependant, quelle est l’influence du flux migratoire sur les conflits fonciers intrafamiliaux ?
3-2. Influence de la rurbanisation à Adjamé-Bingerville
3-2-1. Migration comme fondement des tensions au sein du lignage
Facteur de production et de reproduction du groupe social, le foncier à Adjamé-Bingerville constitue
une ressource incontournable dans les pratiques et rapports sociaux qui se nouent entre tous les acteurs de cet
espace social. Situé à la périphérie de la ville de Bingerville, Adjamé-Bingerville connaît un flux migratoire
important. Elle accueille des populations allochtones (Baoulé, Agni, Senoufo, Malinké, Bété, Lobi, etc.) et de
non ivoiriens (Burkinabés, Maliens etc.). La population non ivoirienne de cette communauté représente 25% de
la population locale (INS, 2014). Avec la disparition progressive des cultures pérennes et la gestion
individualisée de la ressource foncière, (du fait de l’introduction de l’économie marchande à Adjamé-
Bingerville), l’on constate des tentatives d’acquisition des terres lignagères par des "étrangers". La rurbanisation
du village symbolisée non seulement par la mise en valeur du patrimoine foncier villageois mais aussi par la
construction de logements urbains échappe au contrôle de la chefferie et des gestionnaires des terres familiales
au profit d’acteurs appartenant aux familles (jeunes et héritiers en ligne agnatique). Ces derniers mettent les
terres en location aux allochtones et non-ivoiriens. Le discours de G.L. chef de famille et gestionnaire de terre
familialenous renseigne sur cette question :
« Depuis que les étrangers sont là et ils ont vu que nos jeunes et nos
frères ont des soucis d’argent, ils n’hésitent pas, à vouloir, pas
seulement à vouloir, mais à acheter nos terres. Pourtant, ils savent
que ce n’est pas possible parce qu’ils ne sont pas du village. Mais
bon, tout ça, c’est le développement et la modernité qui occasionnent
toutes ces actions. A cette allure-là, on ne saura plus à qui appartient
les terres du village si ces tentatives d’achat de nos terres continuent.

La vente des terres familiales à des « étrangers » et ce, à l’insu de la chefferie villageoise et des
gestionnaires des terres familiales est à l’origine de nombreux conflits intrafamiliaux, mais dégénère très
rarement en conflit intracommunautaire. Au vu de ce constat, les autorités coutumières ainsi que les détenteurs
des droits fonciers coutumiers des différentes familles qui composent le village ont décidé de sécuriser les terres
familiales par l’immatriculation et l’établissement d’un certificat foncier qui formalise leur droit de gestion de la
terre afin de prévenir une résurgence des conflits intrafamiliaux qui peuvent basculer en conflits
intercommunautaires. Par ailleurs, la rurbanisation du village induit des mutations sociales dans la gouvernance
foncière qui s’exprime par la recomposition dans la gestion de l’héritage.
3-2-2. Recomposition dans la gestion de l’héritage
Les conflits fonciers intrafamiliaux observés dans l’espace social d’Adjamé-Bingerville influencent les
rapports fonciers au sein de l’espace familial. En effet, la récurrence de ces conflits fonciers dans les champs
familiaux contraint les acteurs à un réaménagement, une reconstruction du droit foncier en matière de gestion de
l’héritage. Ce réaménagement du droit foncier est symbolisé par l’intégration de certains ayants droit dans la
distribution de l’héritage. Cependant, cette nouvelle pratique n’est pas vulgarisée dans le village. G.G chef de
famille et impliqué dans les conflits fonciers intrafamiliauxapporte un éclairage sur cette question :
« Dans notre famille, il y a trop de palabres à cause de l’héritage et
c’est comme ça partout au village. Mais nous, on a décidé que pour
éviter que cela se reproduise, on prend en compte les enfants afin
que les palabres cessent une bonne fois et pour l’instant, rien à
signaler. Cependant, dans les autres familles, ils n’ont pas encore
adopté ça. Je crois qu’il y a deux ou trois familles qui font la même
chose. On espère qu’au fil du temps, tout le monde va modifier un
peu ces principes. On ne demande pas de tout changer, mais de
faire certains efforts afin qu’on puisse vivre dans la paix parce
qu’on est fatigué des palabres au village ici ». (G.G chef de famille

et impliqué dans les conflits fonciers intrafamiliaux, ce 26 décembre
2020, Adjamé-Bingerville).
La persistance des conflits fonciers à Adjamé-Bingerville induit une reconstruction du mode de gestion
de l’héritage. On assiste de ce fait à un assouplissement des règles en matière d’accès à l’héritage. Cette pratique
d’intégration des ayants droits en ligne agnatique dans la gestion du patrimoine foncier familial représente un
hybridisme du droit coutumier qui est symbolisé par l’intégration de la loi moderne dans le système de gestion
de l’héritage. En effet, le conflit foncier mobilisé par les jeunes dans le but de réévaluer les modes de gestion
foncière est un facteur d’intégration sociale. Ainsi, la rurbanisation a permis l’évolution et la séparation du
patrimoine foncier.
3-2-3. Distinction entre patrimoine foncier familial et patrimoine personnel
Le droit coutumier dans le principe de gestion des biens familiaux désigne les neveux utérins ainsi que
les chefs de famille comme les gestionnaires des biens familiaux. Ils détiennent de ce fait les droits
d’administration et de distribution des terres à l’intérieur du lignage. Les héritiers en ligne agnatique
revendiquent le droit de gestion de l’héritage conformément au droit positif qui leur accorde la légitimité. Dans
cette logique certains chefs de famille à Adjamé-Bingerville dans le but d’éviter la dépossession de leur
progéniture procèdent à la distinction des biens familiaux et des biens personnels. Cela ressort des propos de
K.L. chef de famille et héritier du patrimoine foncier familialqui s’exprime en ses termes :
« Moi, j’ai décidé pour éviter qu’il y ait tout le temps palabre et que
mes enfants se retrouvent sans rien à ma mort et que mon neveu ne
garde pas tout. J’ai décidé de faire la différence entre les biens de
la famille et mes biens. C’est une technique qui évite beaucoup de
chose. Regarde-moi par exemple quand ils m’ont désigné comme
héritier des biens de la famille comme notre coutume le demande,
mes neveux n’étaient pas contents, ils ont contesté. J’ai décidé moi-
même de clarifier les choses. Cela me soulage ». (K.L. chef de

2020, Adjamé-Bingerville).
Cette position, adoptée par certains chefs de famille, met en évidence les mutations à l’œuvre au niveau
de la gestion de l’héritage. Elle est une stratégie qui consiste à prévenir une résurgence des conflits fonciers
intrafamiliaux qui déstabilisent les liens à l’intérieur du système familial. La création, la mobilisation d’un
patrimoine foncier personnel en marge de celui du champ familial se matérialise par l’achat, la location des
terres coutumières du village d’Adjamé-Bingerville. Ces terres font l’objet d’un transfert de droit sans
contestation possible des membres du lignage. Cette pratique sociale est de plus en plus mise en œuvre par les
différents acteurs et gestionnaire des terres à Adjamé-Bingerville. Cette nouvelle pratique à l’œuvre au niveau
de la gestion foncière est une stratégie de contestation, de contournement et délégitimation du droit foncier
traditionnel de la part des acteurs qui sont légitimés par le droit coutumier en matière de gestion des biens
familiaux. Cette analyse met en lumière la dynamique foncière observée dans la société ébrié d’Adjamé-
Bingerville. Cette dynamique (changement) tente progressivement d’apporter des réponses à la résurgence des
conflits fonciers. Ces réponses ne relèvent pas d’une formalisation de règles, mais plutôt d’arrangements tacites
qui sont des prédispositions à la mise en œuvre d’une recomposition des rapports fonciers dans l’espace social
d’Adjamé-Bingerville. La pratique de séparation du patrimoine foncier familial et du patrimoine personnel est
de plus en plus utilisée par les cadres et personnalités influentes qui perçoivent cette pratique comme un moyen
de protéger leur patrimoine personnel. Elle permet de favoriser les héritiers en ligne agnatique dans la
succession des biens au niveau de leur espace familial. La persistance des conflits fonciers intrafamiliaux à
Adjamé-Bingerville crée une forme d’arrangement et un hybridisme au niveau de la gestion de l’héritage dans le
but de prévenir une résurgence des tensions dans l’espace familial. Ces mutations sociales à l’œuvre dans la
gestion foncière sont liées à l’influence de la rurbanisation dans les différentes pratiques foncières.
IV. DISCUSSION
L’analyse surle rôle de rôle de la rurbanisation montre la faiblesse des institutions coutumières au
niveau de la gestion foncière qui conduisent les acteurs (migrants) et les institutions étatiques à s’aménager des
zones de libertés en contournant les règles régissant l’organisation foncière. Ces pratiques fragilisent les rapports
à l’intérieur du champ familial et conduit à la méfiance et à la défiance des cadets à l’égard des institutions et
des règles du jeu coutumier. Elles entraînent ainsi la rupture du lien social avec les gestionnaires des terres
familiales. Ce constat est repris par Houedin et Diaby (2017), dans l’analyse des pratiques de conservation de la
terre à Adjamé-village. Ces auteurs expliquent la monopolisation de l’Etat sur le contrôle de la terre. Selon les

autochtones Ebrié, depuis toujours, l’Etat s’impose comme le « maître absolu » sur la terre comme si cela allait
de soi. En usant de la « force » pour dissimuler ces pratiques d’expropriation de terre. En effet, tel que prescrit
par le décret n˚68-77 du 9 février 1968, l’Etat en vue d’asseoir son contrôle vis à vis de l’extension de la ville et
afin de contourner les contraintes coutumières liées au foncier se déclare propriétaire de la « totalité » du
territoire non urbanisé. Dans cette même optique, s’intéressant à la relation entre conflits fonciers, rurbanisation
et la migration, Tchekote (2010) et Traoré (2012), soutiennent que l'absence de règlementation limitant l'accès
de l'acquisition massive des terres et dans leur élan d’acquisition absolue des lopins de terrain au village,
nombreux sont les citadins qui courtisent des paysans véreux qui arrivent souvent par pure manigance sur fond
de cupidité à leur vendre des terrains litigieux. Ces tensions obligent certains à procéder à la sécurisation de
leurs parcelles par l’établissement des titres fonciers et par des clôtures en parpaings ou en fil barbelé. Comme le
souligne Crozier et Friedberg (1977), qui considèrent en effet ces interactions sociales comme des « jeux » où
les acteurs se comportent comme des manipulateurs d'informations et de règles pour atteindre leurs intérêts. Les
dynamiques foncières observées dans l’espace social d’Adjamé-Bingerville en rapport avec la rurbanisation
participent à la résurgence des tensions intrafamiliales liées à la ressource foncière. Ces conflits fonciers
intrafamiliaux conduisent les différentes familles du village à une recomposition des rapports et des pratiques
sociales au niveau de la gestion de l’héritage. On observe de ce fait un contournement des droits successoraux
traditionnels afin d’intégrer les ayants droits en ligne agnatique excluent par le système matrilinéaire à être
intégré dans la gestion et la redistribution de l’héritage. L’analyse de Coulibaly (2015)sur les conflits fonciers
intrafamiliaux dans le pays Sanwi met en évidence des conséquences observables au niveau de l’impact des
conflits fonciers intrafamiliaux sur la parentalité Agni. L’étude montre la revisitation contemporaine du système
matrilinéaire dans ses aspects structurels et fonctionnels par la prise en compte, dans la rente des plantations, de
la veuve et de la descendance directe. Dans cette optique, Coser (1956) développe l'idée que le conflit peut
remplir une fonction d'intégration sociale. Les conflits sociaux internes (concernant les relations à l'intérieur
d'un groupe) peuvent souder la collectivité ou, au contraire, la fragiliser selon que les individus qui la composent
partagent ou non les valeurs fondamentales sur lesquelles repose la légitimité du système social.
V. CONCLUSION
Cet article a mis en lumière l’impact du phénomène de la rurbanisation dans le champ foncier familial
qui participe à la persistance des conflits fonciers dans l’espace périurbain ébrié d’Adjamé-Bingerville.
L’introduction de l’économie monétaire dans cet espace social participe à la restructuration de cet espace social
à travers la modernisation du foncier. Ces mutations favorisent une forte migration qui suscite une demande de
terre de la part des migrants. Face à cette pression, on assiste à la marchandisation des rapports fonciers à
l’intérieur du champ familial par les cadets du lignage. A cet effet, le conflit apparaît comme l’expression de
l’affirmation des mutations sociales à l’œuvre dans le champ familial face au conservatisme des aînés. A cet
effet, la désappropriation des terres familiales par l’Etat avec l’appui de la chefferie villageoise, ainsi que les
pratiques d’acquisition des terres familiales par les « étrangers » ne respectent pas les normes du village
conduisent les chefs de famille à sécuriser les droits sur les terres à travers l’immatriculation et l’établissement
de certificat foncier.
