Universal accessibility in supermarkets and pharmacies in Quebec

The mission of the Commission des droits de la personne et des droits de la jeunesse is
to ensure the promotion and respect for the principles contained in the Charter of
Human rights and freedoms. Between September 2009 and March 2010, the
Commission has observed a significant increase in complaints, which the object
concerned specifically the accessibility of banking payment terminals. During the year
2011-2012, the Commission received 353 complaints of discrimination based on
disability or the means to compensate for the disability.
In this context, the Commission has developed a project to raise awareness of the main
supermarket chains and pharmacies of Quebec in respect of the right to equality for
persons with disabilities so that they make their businesses accessible. According to the
Charter, persons with disabilities are entitled to the same treatment and the same
access to services and goods than the general population. Businesses have the
obligation to guarantee access to all.
As a first step, in 2011, a partial audit of the accessibility of shops (pharmacies and
supermarkets) was made. Persons with disabilities visited 52 businesses in several
cities in Quebec and assessed several dimensions of accessibility of these businesses.
As a result of these audits, a portrait of the lack of accessibility of these businesses was
presented to each head of the (supermarket and pharmacy) chains involved. The
Commission then asked them to commit to six points. In order to measure the scope of
these commitments, the Commission returned in 2014 to the stores to check if
noticeable improvements had been made. The Commission has also collected the
testimonies of various people with disabilities on their shopping experiences in these
supermarkets and pharmacies.

La Commission des droits de la personne et des droits de la jeunesse a pour mission de
veiller à la promotion et au respect des principes contenus dans la Charte des droits et
libertés de la personne. Entre septembre 2009 et mars 2010, la Commission a observé
un accroissement significatif des plaintes, dont l’objet concernait plus particulièrement
l’accessibilité des terminaux de paiement bancaire. Durant l’année 2011-2012, la
Commission a reçu 353 plaintes de discrimination fondée sur le handicap ou sur le
moyen pour pallier le handicap.
Dans ce contexte, la Commission a développé un projet pour sensibiliser les principales
chaînes de supermarchés et pharmacies du Québec au respect du droit à l’égalité pour
les personnes en situation de handicap afin qu’elles rendent leurs commerces
accessibles. Selon la Charte, les personnes en situation de handicap ont droit au même
traitement et au même accès aux services et aux biens que l’ensemble de la population.
Les commerçants ont ainsi l’obligation de garantir l’accès à tous.
Dans un premier temps, en 2011, une vérification partielle de l’accessibilité de
commerces (pharmacies et supermarchés) a été effectuée. Des personnes en situation
de handicap se sont rendues dans 52 commerces dans plusieurs villes du Québec et
ont évalué plusieurs dimensions de l’accessibilité de ces commerces.
À la suite de ces vérifications, un portrait du manque d’accessibilité de ces commerces a
été présenté à chaque responsable des chaines concernées. La Commission leur a
alors demandé de s’engager sur six points. Afin de mesurer la portée de ces
engagements, la Commission est retournée, en 2014, dans les commerces pour vérifier
si des améliorations perceptibles avaient été apportées. La Commission a également
recueilli les témoignages de diverses personnes en situation de handicap sur leurs
expériences de magasinage dans ces supermarchés et pharmacies.
