3. INTRODUCTION
Intellectual property (IP) refers to creations of the mind,
such as inventions; literary and artistic works; designs; and
symbols, names and images used in commerce. IP is
protected in law by, for example, patents, copyright, design
protection and trademarks, which enable people to earn
recognition or financial benefit from what they invent or
create. By striking the right balance between the interests of
innovators and the wider public interest, the IP system aims
to foster an environment in which creativity and innovation
can flourish.
4. TRADEMARK ?
A trademark ™ is a
recognizable sign, design or expression which
identifies products or services of a particular source
from those of others. The trademark owner can be
an individual, business organization, or any legal
entity. A trademark may be located on a package,
a label, a voucher or on the product itself. For the
sake of corporate identity trademarks are also being
displayed on company buildings.
5. KFC
• Kentucky Fried Chicken changed its name into KFC in 2005
• They trademarked their name into KFC because it was easy to say and
also the word ‘fried’ didn't sound healthy and to de-emphasize the same.
• Later the state said they would charge fee for using the state name
‘Kentucky’ and thus decided to revert it to KFC.
• The trademark of KFC included the caricature of Harland Sanders, the
founder with 3 colors , red, black & white along with the taglines ‘ finger
licking good’ which was recently in 2013 changed to ‘sogood’ under
restaurant industry.
• The trade mark of KFC is registered under USPTO (United States Patent
and Trademark Office)
6. COPYRIGHT ?
Copyright is a form of intellectual property
applicable to any expressible form of an idea or
information that is substantive and discrete. It is a
legal concept, enacted by most governments, that
grants the creator of an original work exclusive
rights to its use and distribution, usually for a
limited time, with the intention of enabling the
creator of intellectual wealth to receive
compensation for their work and be able to
financially support themselves.
7. CARTOON NETWORK
The cartoon ‘DEXTER’S LABORATORY’ is a copyright shared
by Genndy Tartakovsky and cartoon network. As he is
working as part of Hanna Barbera productions under which
Carton Network is he shared the rights for the real time
success of it.
it is therefore recorded as
copyright owners as The Cartoon Network, Inc., Genndy
Tartakovsky which means cartoon network incorporated
with Genndy Tartakovsky.
8. DESIGN PROTECTION ?
DESIGNS are concerned with the appearance of a
product - features of e.g. shape, configuration,
texture or materials not dictated by functional
considerations. A design means the appearance of
part or of the whole product. It may consist of two-
dimensional features, such as patterns, lines or
colour or of three-dimensional features, such as
shape, texture or surface of an article. There is no
particular acronym for design protection.
9. Taking into consideration the welfare and comfort of babies
in the bath, the French enterprise BABY AND CHILDREN
designed and produced a baby hammock for the bathroom.
Its simple and original design managed to appeal mothers
and babies world wide. In order to ensure protection for its
new product BABY AND CHILDREN deposited an
international application for Industrial Design protection
registration in March 2000. Once the registration was
completed BABY AND CHILDREN managed to
commercialize its product in over 10 countries, either directly
or granting licenses based on its registered industrial design.
The success of this product has been considerable. The
hammock is today one of BABY AND CHILDREN ‘s leading
products and the company, armed with legal monopoly
provided by Industrial Design protection, continues to
market its product around the world.
10. CONCLUSION
Intellectual property (IP) contributes enormously to our
national and state economies. Dozens of industries
across our economy rely on the adequate enforcement
of their patents, trademarks, and copyrights, while
consumers use IP to ensure they are purchasing safe,
guaranteed products. We believe IP rights are worth
protecting, both domestically and abroad.
