Appel des principales organisations internationales d’avocats
Nous, principales associations internationales d’avocats, dont les membres sont épris de Justice et de
Liberté, conscientes de nos devoirs envers les femmes et hommes victimes d’injustices et de violations de
leurs droits :
Constatons que Sakineh Mohammadi ASHTIANI a été sanctionnée par 99 coups de fouet administrés en
présence de l’un de ses deux enfants pour un prétendu « crime » avoué sous la torture et consistant, selon
ses accusateurs, à avoir eu deux relations amoureuses hors mariage.
Estimons qu’un tel châtiment et la présence du fils de la suppliciée constituent des traitements inhumains.
Constatons qu’une nouvelle accusation de meurtre est intervenue après la mort du mari de Sakineh
Mohammadi ASHTIANI et que deux nouvelles condamnations ont eu lieu pour les mêmes faits dont
l’une à la peine de mort par lapidation.
Constatons que les droits élémentaires de Sakineh Mohammadi ASHTIANI à un procès juste et
équitable et à une défense indépendante munie des moyens nécessaires ont été violés, qu’elle n’a pas
eu le droit à un jugement dans une langue qu’elle pouvait comprendre, et que son premier avocat a été
contraint de fuir à l’étranger pour se réfugier du fait de menaces d’emprisonnement.
Constatons que, le 11 août 2010, de prétendus aveux ont été diffusés à la télévision iranienne et que son
actuel avocat a affirmé que cette déclaration – contraire à toute vraisemblance – a été arrachée sous la
torture ou qu’il existe un doute sérieux sur l’identité de la femme apparue à la télévision.
Rappelons que l’honneur d’un pays et son aptitude à la reconnaissance internationale dépendent
aussi du respect du Droit, de la Justice et de la possibilité pour chacun de ses ressortissants d’avoir un
procès équitable, juste, conforme au Droit et de bénéficier d’une défense indépendante, disposant des
moyens utiles et efficaces à son action.
Demandons qu’un nouveau procès respectant les droits de Sakineh Mohammadi ASHTIANI, en
présence d’observateurs internationaux, ouvert au public et conforme aux normes de l’équité, du Droit
et de la Justice ait lieu ; qu’elle y comparaisse libre et y soit défendue par les avocats de son choix.
Demandons que les autorités iraniennes renoncent à son égard à toute forme d’exécution et la remette
sans délai en liberté dans l’attente de ce nouveau procès répondant aux normes internationales de la
Justice.
Encourageons les avocats d’Iran qui luttent pour faire respecter par les autorités iraniennes les droits
humains, les droits des femmes et agissent pour que les peines de fouet, de lapidation et les autres
traitements inhumains similaires soient abolis.
Demandons aux autorités iraniennes de suspendre l’exécution de toutes les peines de mort et de toutes
sanctions inhumaines.

Declaration by the principal international associations of lawyers
We, the principal international associations of lawyers, whose members are ardent advocates of justice and
freedom, are mindful of our duties towards women and men who are victims of injustice and violations of
their rights:
Place on record that Sakineh Mohammadi ASHTIANI was punished by 99 lashes administered in the
presence of one of her two children for an alleged "crime" confessed under torture and which, according
to her accusers, involved two amorous relationships outside of marriage.
Believe that such punishment and the fact that her son was present constitute inhumane treatment.
Place on record that a further accusation of murder has been brought against Sakineh Mohammadi
ASHTIANI following the death of her husband and she has been convicted of two new charges for the
same incident, one of which carries the sentence of death by stoning.
Place on record that the fundamental rights of Sakineh Mohammadi ASHTIANI to a fair and
equitable trial and to an independent defence with appropriate resources have been violated, that
she was not given a verdict in a language she could understand and that her first lawyer was forced to flee
the country and take refuge abroad due to threats of imprisonment.
Place on record that on 11th August 2010, an alleged confession was broadcast on Iranian television and
that her current lawyer has stated that this declaration – which bears no relation to the truth – was either
extracted under torture or that there is a serious doubt as to the identity of the woman who appeared
on television.
Reiterate that the honour of a country and its eligibility for international recognition also depend
on respect for the law, for justice and on the possibility for each of its citizens to have an equitable, fair
trial that complies with the law and to benefit from an independent defence with appropriate and effective
resources.
Demand that a new trial that respects Sakineh Mohammadi ASHTIANI's rights, in the presence of
international observers, which is open to the public and that complies with the principles of equity,
the law and justice be held; that Ms ASHTIANI appear at the trial as a free woman and that she be
defended by lawyers of her choice at this trial.
Demand that the Iranian authorities renounce all intention to execute Ms ASHTIANI and release her
immediately until a new trial is held that conforms to the international standards of law.
Give encouragement to the lawyers of Iran who are fighting to ensure that the Iranian authorities
respect human rights and women's rights, and who are taking action so that lashing, stoning and other
similar barbaric penalties are abolished and that all executions are suspended.
Demand that Iranian authorities put an end to the death penalty and all inhumane sentences.
