공공데이터의 제공 및 이용 활성화에 관한 법률
[시행 2013.10.31. 법률 제11956호, 2013.7.30. 제정]
제1조(목적) 이 법은 공공기관이 보유·관리하는 데이터의 제공 및 그 이용 활성화에 관한 사항을
규정함으로써 국민의 공공데이터에 대한 이용권을 보장하고, 공공데이터의 민간 활용을 통한 삶의
질 향상과 국민경제 발전에 이바지함을 목적으로 한다.
제2조(정의) 이 법에서 사용하는 용어의 뜻은 다음과 같다.
1. "공공기관"이란 국가기관, 지방자치단체 및 「국가정보화 기본법」 제3조제10호에 따른 공공기관
을 말한다.
2. "공공데이터"란 데이터베이스, 전자화된 파일 등 공공기관이 법령 등에서 정하는 목적을 위하여
생성 또는 취득하여 관리하고 있는 광(光) 또는 전자적 방식으로 처리된 자료 또는 정보를 말한다.
3. "기계 판독이 가능한 형태"란 소프트웨어로 데이터의 개별내용 또는 내부구조를 확인하거나 수
정, 변환, 추출 등 가공할 수 있는 상태를 말한다.
4. "제공"이란 공공기관이 이용자로 하여금 기계 판독이 가능한 형태의 공공데이터에 접근할 수 있
게 하거나 이를 다양한 방식으로 전달하는 것을 말한다.
제3조(기본원칙) ① 공공기관은 누구든지 공공데이터를 편리하게 이용할 수 있도록 노력하여야 하
며, 이용권의 보편적 확대를 위하여 필요한 조치를 취하여야 한다.
• 「공공기관의 운영에 관한 법률」에 따른 공공기관
• 「지방공기업법」에 따른 지방공사 및 지방공단
• 특별법에 따라 설립된 특수법인
• 「초ㆍ중등교육법」, 「고등교육법」 및 그 밖의 다른 법률에 따라
설치된 각급 학교
• 그 밖에 대통령령으로 정하는 법인ㆍ기관 및 단체

제12조(공공데이터제공책임관) ① 공공기관의 장은 해당 기관의 공공데이터 제공 및 이용 활성화
에 관한 업무를 총괄하는 책임관(이하 "공공데이터제공책임관"이라 한다) 및 실무담당자를 임명하
고 이를 이용자가 알기 쉽게 해당 기관의 인터넷 홈페이지를 통하여 공표하여야 한다.
제17조(제공대상 공공데이터의 범위) ① 공공기관의 장은 해당 공공기관이 보유·관리하는 공공데
이터를 국민에게 제공하여야 한다. 다만, 다음 각 호의 어느 하나에 해당하는 정보를 포함하고 있
는 경우에는 그러하지 아니한다.
1. 「공공기관의 정보공개에 관한 법률」 제9조에 따른 비공개대상정보
2. 「저작권법」 및 그 밖의 다른 법령에서 보호하고 있는 제3자의 권리가 포함된 것으로 해당 법령
에 따른 정당한 이용허락을 받지 아니한 정보
② 공공기관의 장은 제1항에도 불구하고 제1항 각 호에 해당하는 내용을 기술적으로 분리할 수 있
는 때에는 제1항 각 호에 해당하는 부분을 제외한 공공데이터를 제공하여야 한다.
③ 안전행정부장관은 제1항제2호의 제3자의 권리를 포함하는 것으로 분류되어 제공대상에서 제외
된 공공데이터에 대한 정당한 이용허락 확보를 위한 방안을 제시할 수 있으며, 공공기관의 장은 그
방안에 따라 필요한 조치를 취하여야 한다.
• 국가안전보장ㆍ국방ㆍ통일ㆍ외교관계 등에 관한 사항으로서
공개될 경우 국가의 중대한 이익을 현저히 해칠 우려가 있다고
인정되는 정보
• 공개될 경우 국민의 생명ㆍ신체 및 재산의 보호에 현저한 지장
을 초래할 우려가 있다고 인정되는 정보

제24조(공공데이터의 제공기반 구축) ① 공공기관의 장은 공공데이터를 효율적으로 이용할 수 있
도록 기계 판독이 가능한 형태로 정비하기 위하여 노력하여야 한다.
② 공공기관의 장은 이용자가 공공데이터에 접근하고 이용할 수 있도록 다양한 정보기술을 활용한
제공방안을 마련하여야 한다.
③ 정부는 제1항 및 제2항에 따른 공공데이터의 제공형태 정비 및 제공방안을 마련하는 데 필요한
행정적·기술적·재정적인 지원을 할 수 있다.

 디지털 세계가 지향하는 ‘개방’(Open)은
 내 것을 남에게 보여 주는 데 머무는 것이 아니라,
 누구나 이것을 가지고 새로운 것을 만들 수 있게 하고,
 이것과 다른 것이 관계를 맺어 더 크고 가치 있는 무엇이 이루어질 수 있
게 하는 것.

Open Archives

디지털 아카이브
 디지털 아카이브(Digital Archive)의 함의
• ‘디지털 아카이브(Digital Archive)’는 아직 미정의의 개념.
• 디지털 형태로 태어난 원시 자료(음원, 영상 등)를 보존하는 것을 Digital Archiving이라고 이름
하기도 하고,
• Archives(Institutional Repository) 기능을 수행하는 곳에서 Digital Content를 제공하는 경우,
이를 Digital Archives라고 부르기도 한다.
• 한편, 여러 곳의 독립된 기관들이 메타 데이터 공유의 방법으로 각자의 디지털 콘텐트를 개방
적으로 활용할 수 있게 하려는 시도를 ‘Open Archives’라는 용어로 설명하는데, 여기서 추구하
는 ‘Open Archives of Digital Content’를 Digital Archives의 함의로 이해할 수 있다.
• 국내 공공기관에서 운영하는 ‘디지털 아카이브’는 자기 ‘기관’이 소장 또는 생산하는 자료의 디
지털화와 온라인 서비스를 위주로 하는 것인데 반하여, 디지털 데이터의 생산과 유통에 관한
국제 사회의 선진적인 논의는 이른바 ‘Open Archives’ 또는 ‘Linked Open Data’(LOD)라고 하는
개방과 공유의 세계를 지향하는 데 초점을 모으고 있다.

아카이브 기능을 갖는 기관(Institutional Repository)들이 표준적인 메타
데이터를 생산하고 공유함으로써 이용자들로 하여금 장소와 조직의 경계
에 구애됨이 없이 필요한 데이터에 자유롭게 접근할 수 있게 하는 것

 Europeana as a Semantic Web
• The digital objects that users can find in Europeana are not
stored on a central computer, but remain with the cultural
institution and are hosted on their networks.
• Different types of cultural heritage organizations – libraries,
museums, archives and audiovisual collections – catalogue their
content in different ways and to different standards.
Approaches also vary in different countries.
• Europeana accepts metadata about digital objects, it does not
make any decisions about digitization. The decision about
which objects are digitized lies with the organization that holds
the material.

 EDM: European Data Model
• The Europeana Data Model (EDM) is a new approach towards
structuring and representing data delivered to Europeana by
the various contributing cultural heritage institutions.
• The design principles underlying the EDM are based on the
core principles and best practices of the Semantic Web and
Linked Data efforts to which Europeana wants to contribute.
The model itself builds upon established standards like RDF(S),
OAI-ORE, SKOS, and Dublin Core. It acts as a common top-level
ontology which retains original data models and information
perspectives while at the same time enabling interoperability.

 한글 문화유산에 관한 범국가적 지식 유통망 구상
 한글박물관이 유물의 소장 여부와 무관하게, ‘한글 문화유산’에 관한 지식의 소통에
기여한다는 전제에서 출발
 향후, 한글박물관뿐 아니라 국내외 모든 기관, 개인의 소장 ‘한글 문화재’의 소재에
관한 정보가 이 지식 정보망에 포함되는 것을 지향
 한글 문화재에 관한 실물 정보뿐 아니라, 인터넷 상에서 공유될 수 있는 다양한 디
지털 자원을 적정하게 기술하고, 이것이 실물 정보 및 소장 정보에 연계, 활용될 수
있는 장치를 마련
 한글 문화유산과 관련된 인물, 장소, 역사적 사건 등에 관한 지식을 정보화하고, 이
를 매개로 한글 문화유산에 관한 다양한 지식이 서로에 대해 의미를 갖는 연계망을
형성하도록 함 ☞ Storytelling

 디지털 가상 박물관의 선도적 모델인 Europeana의 데이터 모델을 벤치마킹.
 Europeana는 자체 콘텐츠를 갖지 않고, 유럽 제국의 박물관, 미술관, 도서관 및 다
양한 문화 예술 분야 Digital Library가 제공하는 콘텐츠를 집적하여 세계 최대 규모
의 가상 박물관을 구현. ☞ 성공적인 Sematic Web 개념의 문화 예술 포털(Web of
Data)로서, 한글 디지털 아카이브의 모델로 적합
 단, Europeana는 EU의 정책적 지원과 참여 기관 사이의 긴밀한 협력을 기반으로
구현된 것인 데 반해, 디지털 한글 아카이브는 당분간 그와 같은 제도적 지원을 기
대할 수 없는 상황.
 Europeana의 장점을 최대한 수용하면서, 우리의 환경에 현실적으로 적용할 수 있
는 방향으로 데이터의 틀을 재구성

[전제]
1. 한글박물관은 (한글 문화 유산에 관한 국가 대표 지식 서비스 기관으로
서) 한글 문화 유산에 관한 망라적인 지식 정보 서비스 기능을 수행할
수 있어야 한다.
2. 한글박물관은 현존하는 한글 문화 유산의 일부를 수집·소장하고 있으며,
이를 보존, 전시하는 기능을 수행한다.

[설계 원칙]
1. 지식 정보 시스템과 유물 관리 시스템의 이원화
한글박물관은
- (한글 문화 유산에 관해) 국가를 대표하는 하나의 지식 관리 시스템과
- 이것과 연계된 수많은 소장 유물 관리 시스템(박물관, 도서관, 연구소) 중 하나를 운영
2. 한글박물관의 유물 관리 시스템은 현재 운영중인 “표준유물관리 시스템”
을 활용
3. 지식 정보 시스템의 콘텐츠는 한글박물관이 모든 것을 생산 · 보유하는
것이 아니라 다양한 관련 자원을 집적 · 연계하는 형태로 존재

3. 정보 자원의 속성 및 유관 자원과의 관련성을 명시적으로 드러내는 술어
(Predicate)의 이름 공간(Namespace) 제정
4. 1, 2, 3의 기반 위에서 수집·조사된 자원의 관계성을 정의하고 이를 데이터베이스
에 수록

 객체 식별자가 필요한 이유:
 월드 와이드 웹의 세계에서 관련 지식 객체 사이의 명확한 ‘관계 맺음’을 이루기
위한 첫번째 요건.
Publishing LOD requires a few essential components, the first of which is that
each entity must have a unique resource identifier (URI) (Berners-Lee, 2006).
 강제적인 데이터 통합 장치가 없는 상황에서, 자율적인 ‘관계성 기술’만으로 지식
연계망의 구현이 가능할 것을 기대. (Linked Open Data)
 특정 분야 국가 지식 포털의 기능을 수행하려는 공공 기관에서 선도적으로 수행
해야 할 과제.

 이름 공간(Namespace)을 사용하는 이유
 한글 문화유산 지식 정보의 다양한 속성을 명시적으로 표현하기 위해 사용.
 속성 이름을 새롭게 정의하기보다는 월드 와이드 웹의 세계에서 널리 통용되고
있는 이름을 사용함으로써 데이터의 소통성 확보
 한글 문화유산 지식을 전자적으로 기술하기 위해 사용하는 이름 공간은 대부분
Europeana가 사용하는 것을 차용
