Mapping varieties of industrial relations: Eurofound's conceptual framework a...Eurofound
The report describes a methodology used to select indicators that map national industrial relations systems according to Eurofound's conceptual framework of four key dimensions: industrial democracy, industrial competitiveness, social justice, and quality of work and employment. A dashboard of 45 strict quality-based indicators was compiled from European data sources for 2008-2015. National experts evaluated the dashboard's accuracy in portraying their country's system. Their feedback was used to refine the indicators and identify conceptual challenges in some dimensions' relationships to industrial relations actors and processes.

This research report explores the concept of representativeness of social partners at the national, international, and European levels. At the national level, representativeness is defined in different ways across EU member states, with some relying more on legal conformity to formal criteria while others emphasize mutual recognition among social partners. Four main models of representativeness are identified at the national level. At the international level, the International Labour Organization and Council of Europe have discussed representativeness. At the European level, representativeness is important for determining which social partners can be consulted by the European Commission and help implement agreements. The report aims to better understand differences in national approaches and discuss how representativeness is defined at different levels.

2. 1. Contexte de l'étude
• la représentativité
constitue le fondement du droit des partenaires sociaux
européens
à être consultés par la Commission (CE) conformément à
l'article 154 du Traité sur le fonctionnement de l’ Union
européenne (TFUE)
à s'engager dans des négociations qui puissent aboutir
aux accords mis en œuvre par décision du Conseil (155
TFUE)

• a) être interprofessionnelles, sectorielles ou catégorielles et
être organisées au niveau européen;
• b) être composées d'organisations elles-mêmes reconnues
comme faisant partie intégrante des structures des
partenaires sociaux des États membres et avoir la capacité
de négocier des accords et être représentatives et être, dans
la mesure du possible, représentatives dans tous les
Etats membres;
• c) disposer de structures adéquates leur permettant de
participer de manière efficace au processus de consultation.
4. 2. Arrêt UEAPME (T-135/96)
• l’UEAPME contestait la légalité de la directive sur le congé
parental et le litige a été porté devant le Tribunal de Première
Instance de l’Union (TPI)
• le TPI a déclaré que les accords conclus qui sont ensuite mise
en œuvre par une directive peuvent être contestés sur la base du
respect du principe de démocratie
• le TPI a jugé que l’action est fondée dans la mesure où la
directive n’avait pas été soumise au contrôle du Parlement
européen
• la CE a la responsabilité juridique d’exercer un contrôle en
vue d’identifier les partenaires sociaux européens habilités à
s’engager dans le dialogue social européen

négociateur en chef

également prise par le Conseil des Présidents
le consensus de tous les membres ayant droit de vote et
dont le pays est affecté par l'accord en question est
nécessaire pour obtenir l'approbation d'un accord
